If the Court determines that the proper legatees are the living
relatives of both Marko Bingula and Veronica Bingula,i,t is suggested that
the money be paid into Court subject to an investigation to find all the
legatees.If the Court determines that the proper legatees are the relatives
of Marko Bingula only on the information which I have from the Yugoslavian
consulate and on the basis of a power of attorney signed by Tomo Bingula,
who resides in Zagreb,Yugoslavia,I would suggest a distribution of the
balance of the estate to Tomo Bingula.

First.That all our just debts and funeral expenses be fully paid

Second:In the event of the death of both of us,or atter the
death of the survivor,it is our desire that all our properties be
sold and the proceeds of.such sale,less necessart expenses,be
divided,in se far as possible,between the surviving relatives of

and papers in our possession will furnish addresses af said relatives.

TO MAKE PRIVATE SALE OF REAL ESTATE

The Petition of George Kover and Andy Medved,
Executors of the Estate of Marko Bingula,Deceased,by their
attorney,George K.Hanna,respectfully represents:
1.Your petitioners are the Executors of the Estate
of Marko Bingula,Deceased,having been appointed on May 12,
1967.
2.Under Paragraph 2 of the Will of Marko Bingula,
the Executors were empowered to sell all properties and the
proceeds of the sale were to be divided between the survi~ing
relatives of the family of Veronica Bingula and Marko Bingula,
who are residing in Yugoslavia and Czechoslovakia.
3.That your petitioners have received a bid for all
the properties of Marko_Bingula_as described hereinafter in the
amount of $4,750.00 from Eugene Raggi and Erma Raggi,his wife,
which they believe to be a better price than can be obtained
by a public sale of the real estate.A copy of the agreement
of sale is attached as Exhibit "A".'
The real estate which is the subject of said sale is
described as follows:
TRACT NO.1.ALL that certain tract or parcel of
ground situate in Smith Township,Washington County,
Pennsylvania,bounded and described as follows,to wit:
BEGINNING at a stake on the line of property
of James and Mary Bailey at the corner of property of

Fairview Cemetery,thence by said Bailey line South 86°
30'East 650 feet to the center of public road;thence
by said road North 21°20'West 243.79 feet to a pin;
thence by same road North 51°55'West 615.15 feet to
a pin in center of said road and at the corner of
property of the Fairview Cemetery Association;thence
by said cemetery line South 7°37'West 571.7 feet to
the place of beginning.Containing 5.128 acres.
TRACT NO.2.ALL those certain lots of
ground situate in Smith Township,Washington County,
Pennsylvania,and known and designated as Lots Nos.
1,2 and 9 in a plan of lots laid out by A.C.Berry
and which is recorded in the Recorder's Office for
Washington County in Plan Book No.4,page 33.Said
plan of lots being a part of the tract of land conveyed
to the said Lillie M.Berry by M.W.Scott and W.F.
Scott;executors of the last will of R.K.Scott,
deceased,by deed dated April 3,1911,and recorded
in the Recorder's Office of said County of Washington
in Deed Book 389,page 115,said lots being further

and thirty-three foot Township Road,thence by thirty-

4.Although the executors have authority to make such
sale,they desire that public notice be given of said sale due
to the special circumstances that there are no heirs of the
decedent living in the United States who could possibly question
the propriety of said sale.
5.Your petitioners,therefore,desire that a date
be set for the confirmation by the Court for the sale and that
said sale will be advertised once in the Legal Journal and
once in the Burgettstown Enterprise.

AND NOW,this 20th day of May,1968,hearing having been
held in open Court after proper advertisement according to Order
of Court;and additional bids having been made at said hearing,
the private sale of the property of Marko Bingula,deceased,to
Eugene Raggi and Erma Raggi,his wife,is hereby confirmed.The
total purchase is $6,575.00,and the property which is the sUbject
of this sale is described as follows:
TRACT NO.1.All that certain tract or parcel of
ground situate in Smith Township,Washington County,
Pennsylvania,bounded and described as follows,to wit:
BEGINNING at a stake on the line of property of
James and Mary Bailey at the corner of property of
Fairview Cemetery,.thence by said Bailey line South 86°
30·East 650 feet to the center of public road;thence
by said road North 21°20'West 243.79 feet to a pin;
thence ,by same road North 51°55'West 615.15 feet to
a pin in center of said road and at the corner of
property of the Fairview Cemetery Association;thence
by said cemetery line South 7°37'West 571.7 feet to
the place of beginning.Containing 5.12~acres.

SUPPLEMENTAL PETITION FOR DISTRIBUTION
TO THE HONOR.ABLE,THE JUDGES OF SAID COURT:
The Petition of Milos Nikolic,Acting Consul General of the
Socialist Federal Republic of Yugoslavia,respectfully represents:
1.Adjudication and Decree of this Court dated October 29,1968
distributed the balance of the estate in the amount of $4,678.89 to
"Russell Marino,Clerk of the Orphans'Court as money paid into Court for
the use of the heirs and/or legatees of the deceased as may be determined
by the Court'!.
2.Milos Nikolic is the acting Consul General of the Socialist
Federal Republic of Yugoslavia located at 625 Stanwix Street,Pittsburgh,
Aalegheny County,Pennsylvania.
3.Tomo Bingula is the natural brother of the Decedent Marko
Bingula and is the only living heir as is evidenced by the Family Tree Report,
an original and translation of which are attached hereto and marked as
Exhibits "A"and "B"and by an Affidavit of Identity executed by Tomo Bingula
attached hereto and marked as Exhibit "C".
4.The Decedent Marko Bingula and his wife Veronica Bingula
executed a joint Last Will and Testament in which they provided:
Second:"In the event of the death of both of us,or
after the death of the survivor,it is our
desire that all our properties be sold and
the proceeds of such sale,less necessary
expenses,be diVided,in so far as possible,
between the surviving relatives of our
respective families in Jugo-Slavia and Cheko-
Slovakia,letters and papers in our possession
will furnish addresses of said relatives."
5.Veronica Bingulagpredeceased Marko Bingula.
6.Your Petitioner has made a diligent and thorough search for
heirs of Marko Bingula and Veronica Bingula.
7.A copy of a letter to and a copy of reply from the Embassy
Of The Czechoslovak Socialist Republic are attached hereto and marked as
Exhibits "D"and "Ell respectively.
8.In spite of a diligent and thorough searclt no further
information is available in order to assist the Embassy Of The Czechoslovak
Socialist Republic as requested.
9.The only living heir of either Marko Bingula or Veronica
Bingula which has been uncovered is Torno Bingula who resides in the Socialist
Federal Republic of Yugoslavia.
10.There has been no claim for distribution other than that
of Torno Bingula.
WHEREFORE,your Petitioner prays that the Court Adjudicate and
Decree that Torno Bingula is the only living heir of Marko Bingula and that
the Clerk of the Orphans I Court of Washington County be ordered to release
the funds in the amount of $4,678.89 to Milos Nikolic,acting Consul
General of the Socialist Federal Republic of Yugoslavia.

Marko Bingula and Veronica Bingula executed a Will wherein they left
their estate to be div1ded.trbetween the surviving relatives of our
respective families in Yugoslavia and Czechoslovakia.11 I have located
all surviving relatives of MarkoBirigula but have been 1.1IlBble to locate
8l1iY relatives of Veronica Bingula nee Valek whose relati.ves,if any,
would be jn Czechoslovakia.
Veronica Bingula nee Valek died prior to her husband Marko who
died on February 11,196'7.The last known address of the late Varoonica
