Estate of Janet ~.Acheson, deceased. )In the Court of Common Pleas of··)Washington County,Pennsylvania··)Orphans'Court Division··)No.63-68-616 PETITION FOR THE APPOINTMENT OF NEW EXECUTORS UNDER THE PROVISIONi OF THE ACT OF 1972,NO.164,AS AMENDED (20 Purdon's Pennsylvania Statutes,Section 3182 and 3183) TO THE HONORABLE,THE JUDGES OF SAID COURT: 1.Your petitioners are Ernest F.Acheson of Hopewell Township,Washington County,Pennsylvania,and David A.Donnan of Upper St.Clair Township,Allegheny County,Pennsylvania,both of whom are nephews of the said Janet W.Acheson,deceased. 2.That Janet W.Acheson,late of Hopewell Township, Washington County,Pennsylvania,died,testate,April 7,1968. 3.That Letters Testamentary upon her estate were issued to her brother,Alexander W.Acheson,a member of the Washington County Bar and a resident of Washington,Pennsylvania, by the Register of Wills of Washington County,Pennsylvania,on April 22,1968.At the present time Alexander W.Acheson is staying with his daughter,Mrs.Thomas S.Taylor,at Mountain Lakes,New Jersey. 4.That the said Executor,within ninety days of his sister's 'death,made a payment of $14,297.21 to Russell Marino,, Agent of the Department of Revenue of the Commonwealth of Pennsyl- vania,on account of the Pennsylvania Collateral Inheritance Tax. I 5.That the said Executor filed a Federal Estate Tax Return and paid to the Internal Revenue Service the sum of $13,000.00,the amount shown to be due thereon,within the period of fif~een months following her death. 6.That the said Executor caused to be pUblished the usual estate notices in the Washington County Reports and in the Washington,Pennsylvania,Observer. 7.That the said Executor has paid his sister's funeral bill,as well as all other bills of which he has knowledge or notice. 8.That the said Executor has prepared an Inventory and Appraisement of the 'assets of Janet W.Acheson,deceased,as follows: Personalty Realty Total $200,512.31 7,955.00 $208,467.31 9.That said Inventory and Appraisement has not been execute~nop,sworn to by the said Alexander W.Acheson,Executor, and has not been filed of record in the Register of Wills Office of Washington County,Pennsylvania. 10.That at the present time Alexander W.Acheson, Executor of the Estate of Janet W.Acheson,deceased,has the following assets in this estate: Checking Account,Mellon Bank,N.A._ Washington,Pa.,Office $135,000.00 Savings Account,Pittsburgh National Bank,Washington,Pa.,Office 13,000.00 Unconverted Realty 7,955.00 - 2 - Unsold Stocks and Bonds (amount unknown)00.00 $155,955.00 11.That the said Alexander W.Acheson,because of his age,(89 in October,1974)and because of illness and physical incapacity,is unable to discharge the further duties of his Office,and his continuance in office is likely to jeopardize the interests of said 'estate. 12.A copy of said Last Will and Testament,marked Exhibit No.1,is attached hereto and made a part hereof. 13.That the FOURTH PARAGRAPH of Janet W.Acheson's Last Will and Testament,dated November 20,1964,and dUly probated in the Register of Wills Office in Will Book Vol.105, at Page 470,is as follows: ItAs i!:xecutor of this will I appoint my brother,ALEXANDER W.ACHESON.In the event,. that my said brother predeceases me,refuses or is unable to serve as my Executor,then I appoint my two nephews,ERNEST F.ACHESON and DAVID A.DONNAN'as Executors of this will, and I direct that my Executor or Executors shall not be required to give security in any jurisdiction in which they may act.1t WHEREFORE,your petitioners,showing as aforesaid, request that your Honorable Court make an Order requiring the said Alexander W.Acheson to appear and show cause Why he should not be removed as Executor of the Estate of Janet W.Acheson and further - 3 - that the Register of Wills of Washington County,Pennsylvania be directed to grant new Letters Testamentary upon the Estate of Janet W.Acheson to your petitioners,Ernest F.Acheson and David A.Donnan.
