BIRTH RECORD PROCEEDINGS ) OF PATRICIA ANN DURILtA : .No • PETITION TO CORRECT BIRTH RECORD TO THE HONORABLE P.V.MARINO,PRESIDENT JUDGE OF SAID COURT: The Petition of Martha W.Guiddy and John Guiddy respectfully represents: 1.Martha W.Guiddy and John Guiddy are husband and wife and reside at 149 Valley Way,Weirton,West Virginia. 2.Martha W.Guiddy was married on September 27,1941 to George Durilla. 3.The said George Durilla deserted his wife on or about March 1,1942 and they have not seen each other since that date. 4.On August 19,194.5 Patricia Ann Duril1a was born at Independence Township,Washington County,Pennsylvania and her Certificate of Birth shows George Durilla as the father and Martha Washington Crow-.:as the maiden name of the mother.The Certificate of Birth is attached hereto·as Exhibit "An • .5.The said George Durilla was not the father of the child and the father,in fact,was your petitioner,John GUiddy., 6.The said Patricia Arin Durilla is now married and is known as Patricia Ann Kokochak. 7.The said Martha W.Crow,:Durilla divorced the said George Durilla by action brought in The Court of Common Pleas of Washington County,Pennsylvania at No.172,July Term, 1966 A.D. 8.The said Martha W.Dutilla married the said John Guiddy on December 27,1966. 9.The said Patricia Ann Durilla,now Patricia Ann Kokochak,joins in the prayer of this Petition. IN THE ORPHANS'COURT OF WASHINGTON COUNTY,PENNSYLVANIA INRE: Petition to Correct Birth Record of PATRICIA ANN DURILLA ( ) ( ) ( DECREE No.587 of 1968 AND NOW,May 8,1968,pursuant to a hearing duly held on Tuesday May 7,1968,after proper notice given,and at which all interested parties were present and represented by counsel,this Court finds as follows: 1.That ~ccording to docu;mentary and other substantial and sufficiel t evidence presented to the Court,a female'child heretofore known"as Patricia Ann Durilla was born August 19,1945,in Independence Township,Washingtor County,Pennsylvania. 2.That the natural mother of said qhild;Martha W.Guiddy r 'I'• (formerly Martha W.Durilla),inadvertently supplied the authorities at the time of birth of said child with the information leading to the use of the name Patricia Ann Durilla for said child;this action was not a willful misrepre- sentation by the natural mother of the said child but the name was simply given because the natural mother of said child had been married to one George Durilla for some years prior to the birth of said child,having been so married on September 27,1941,to the said Mr.George Dur illa.However, the said George Durilla willfully and maliciously deserted his wife,the natural mother of said child,on March 1,1942,and the natural mother has not cohabited and lived with him as husband and wife after said date. 3.The natural mother of said child lived and cohabited with her present husband,John Guiddy,from and after the month of September,1943 '. To this union there were born three children,the first of which was Patricia Ann (Durilla),born August 19,1945. 4.That the said child was of illegitimate birth,but since the natura mother of said child married the natural father of said child on December 27, 1966,in Washington,Pennsylvania,the said child becomes the legitimate child of said parents in pursuance of said marriage by reason of the relevant statutes of the Commonwealth of Pennsylvania. 5.That the surname of said minor child should be changed to the proper surname of the putative or natural father of said child (since the natural father is now married to the natural mother),so that the name of the said child should appear as Patricia Ann Guiddy. NOW,THEREFORE,under authority of Section 301 (15)of the Orphans'Court Act of August 10,1951,P.L.1163,as amended by the Act of August 4,1955,'P'.'-(L.302"and Actsof.1857{an9-1959;it is..~.'.,"-..:.....
