asset in the estate of decedent,there being no personal property.
5.Your petitioner filed bond in the amount of
$4,000.00,on grant of Letters,on which the Peerless Insurance
Company was the corporate surety.
6.Attached hereto and made a part hereof is a copy
of the Articles of Agreement for the sale of said property to
SARAH W.ANTHONY and JOHN ANTHONY,her husband,for the agreed
sale price of $3,000.00.
WHEREFORE,your petitioner prays your Honorable Court
to make an Order fixing further bond to be filed or waiving
additional security.

she and her husband had lived.The husband died November 21,
1938,intestate,leaving to survive as sole and only heirs his wido'A
Elizabeth Weaver,the present decedent,.also known as Sarah
E.Weaver,and the fbllowing children:Thomas Calvin Weaver,
David F.Weaver,William M.Weaver and Sarah Weaver,now
intermarried with John Anthony.Mrs.Weaver,the decedent,live(
in her home with the daughter and her husband.The boys thought
enough of their sis ter that they turned their interest in their fa ther'
estate over to the sister because she was taking--had full charge
of the mother.Now since 1938 she and her husband have supported
the widow,Mrs.Elizabeth Weaver.Althgugh she would neither maKe
a will nor assign her one third interest.

THE COURT:The one third interest that she had in the property
was derived from her husband.
MR.RALSTON:That's right.Although she made at least two mo e
mortgages---I'm reading from a mortgage to the First National Ba k
,and Trust Company,now the Pittsburgh National,which has been
satisfied,but she evidently made anotlE r one to some Troy :Hill
Building and Loan,which is stil~the mortgage is still in existence i nd
for which---

She could only mortgage her one third interest.
Yes,and the daughter and her husband mortgaged
the other two thirds.

What are we going to do about that?
Well,I've taken credit for that in the a'ccount
for her share of it.But they intend to pay it off.Now we had the
brother take out Letters on her estate,the brother Thomas C.
Weaver.Administrator.in order that we could have him deed the 0 e
third interest over to the daughter.which has been done under your
jurisdiction.

that was in the meantime.one of the sons.William McCQnnell
Weaver,the Second,died August 1,1961.leaving children Pauline
W.Doudrick.married duaghter.and three sons.whom I understan
are not of age~William McConnell Weaver.III,John 'F.T.Weave"'.
and Richard A.Weaver.,I believe the Anthonys,the daughter of thE
decedent,has the one son Richard Weaver,and raising him.but
the other two are in the Hershey home at Hershey.Now,as a
matter of fact.this is a tempest in the teapot because there is no
money for distribution.But I wanted to make that explanation so
that the Court would understand just the makeup of that mortgage.
