PERSONAL REPRESENTATIVE OF REAL ESTATE UNDER
THE PROVISIONS OF SECTION 546 OF THE FIDUCI-
ARIES ACT OF 1949.
TO THE HONORABLE,p.V.MARINO,JUDGE OF SAID COURT:
The Petition of Belle M.Rush and Albert Foster,respectfully!
represents:
1.That Louis D.Rush,a/kia,L.D.Rush,late of Hopewell
I
Township,Washington County,Penna.,died on August 3,1967,I
intestate,leaving as his heirs at law,his widow,Belle M.Rush,I
Mary Nila Smith,a sister,Stanley Oklahoma Rush,a brother,NanCy\
Fay Foster,a sister,Alberta Stoolfire Jordan,a sister,and !
John Alexander Rush and Donald Albert Rush,nephews and the sons
of a deceased brother,Albert J.Rush.
2.That Letters of Administration on his estate were
granted August 29th,1967,to Belle M.Rush,widow,and Albert
Foster,a nephew,and Surety Bond filed by them in the amount of
$40,000.00.
3.That the estate of the deceased consisted of
$57,516.19 in personalty,and two farms in Hopewell Township,
Washington County,Penna.,appraised together at $25,000.00.One
farm consisted of 182.5 acres of land with two sheds thereon,but
no house and is poorly fenced.The other tract contained 26.96
acres,and has an old Ii story frame house,small barn,and
unfinished garage thereon.The larger tract is assessed at
$2490.00,for 1967 tax purposes and is appraised at $10,000.00.
The smaller tract is assessed at $2515.00 for 1967 tax purposes
and is appraised at $15,000.00.See copy of Inventory hereto
attached and marked Exhibit "AU.
4.That your Petitioners have paid the funeral and other

bills of the deceased as well as the bulk
There are no known unpaid bills.The estate is solvent.
I5.That no one has made any offers to purchase said farms I

since the death of Louis D.Rush,but they have not been in any I

real estate agents hands.i

Township,Washington County,Pennsylvania,bounded and described
as follows:
BEGINNING at a white oak stump at corner common to I
land now or formerly of Anna Belle Rush and the tract herein des-i
cribed,thence by land now or formerly of said Anna Belle Rush I
South 38°49'East 1237 feet to a post;thence by land now or for-
merly of Charles Martin South 34°23'West 1270.5 feet to a stake;'
thence by land now or formerly of Lloyd Denning South 61°49'westl
331.8 feet to a stake;thence by land now or formerly of A.J.
Smith Estate North 57°20'West 1666.9 feet to a stake;thence by I
same and land now or formerly of B.F.Miller North 23°09'West

thence by land now or formerly of said Anna Belle Rush South 48°
49'West 172.7 feet to the Place of Beginning.CONTAINING 182.523,
acres,according to survey of Chaney &Armstrong.
EXCEPTING AND RESERVING all the coal of the
Pittsburgh or River Vein and mining rights conveyed by San Jacinto
Rush and others to W.p.Borland by deed dated May 1,1918,and re~
corded in Deed Book Vol.458,page 62.
SUBJECT to existing oil and gas leases and rights
of way for roads,pipe,and utility lines.

see Deed Book 698,page 560,Washington County,Penna.,records.
7.That the smaller tract of land,containing 26.96 acres,
is more fully described as follows:
ALL that certain tract of land situate in Hopewell
Township,Washington County,Penna.,bounded and described as
follows,to-wit:
BEGINNING at a point common to land now or formerly
of the heirs of A.S.Rush,and the tract of land herein described
and conveyed;thence by lands now or late of Nancy F.Foster North
43°41'East 1,096 feet to a walnut tree;thence by same South 50°
37'East 686.9 feet to a point in the road;thence by same and
farm,described in paragraph (6)for the appraisal price of

EXCEPTING AND RESERVING,however,all the coal of
the Pittsburgh or River Vein in and underlying said tract of land,
together with the mining rights and privileges,as conveyed by the
executors of John M.Rush to W.p.Borland,by deed dated
November 14,1919,and recorded in the Recorder's Office of
Washington County,Penna.,in Deed Book 473,page 565.
SUBJECT to existing oil and gas leases and rights
of way for roads,pipe and utility lines.

see Deed Book 700,page 350,Washington County,Penna.,records.
8.That Albert Foster,one of your Petitioners,being
also one of the Administrators of said estate,through his
Execution of this Petition,agrees to purchase the 182.5 aores

$10,000.00,cash,subject to the approval of your Honorable court,'
to be paid upon delivery of a proper deed for said real estate.
9.That Belle M.Rush,one of your Petitioners,also one
of the Administrators of said estate,and widow of Louis D.Rush,
deceased,through her Execution of this Petition,agrees to pur-
chase the 26.96 acre tract,described in paragraph (7),for the
appraisal price of $15,000.00,cash,subject to the approval of
your Honorable Court,to be paid upon delivery of a proper deed
for said real estate.
10.That the other heirs in this estate have notice of
the intended presentation of this Petition and have made no
objection.
11.That the affidavits of two responsible real estate

Notice of this Hearing and of the proposed sale of certain real
estate situate in Hopewell Township,Washington County,Penna.,
being a 260 96 acre farm,to Belle Mo Rush,widow and one of the
Administrators of the Louis Do Rush Estate,deceased,has been
given to all parties as directed by Court,proof of said Notice
having been made by Affidavit and Return Receipts filed,said real
estate consisting of 260 96 acres of farm land with a farm house
and barn thereon,situate in Hopewell Township,Washington County,
Penna.,and as more fully described in Deed Book 700,page 350,
Washington County,Penna.,records,and in Paragraph 7 of the
Petition filed at the above number,for the price or sum of
Fifteen Thousand ($15,000.00)dollars,payable in cash on the
approval of said sale by the Court and delivery of deed;it
further appearing no objections have been filed or better price
offered,the said sale to Belle Mo Rush,Is Hereby Approved,and
It is Further Ordered that the Register of Wills and Clerk of The
Orphans'Court of Washington County,Pennsylvania,Russell Marino,
execute and deliver a Special Warranty deed for said real estate

being a 182.5 acre farm,to Albert Foster,one of the two
Administrators of the Estate of Louis D.Rush,deceased,has been
given to all parties as directed by Court,proof of said Notice
having been sade by Affidavit and Return Receipts filed,said real
estate consisting of 182.5 acres of farm land situate in Hopewell
Township,Washington County,Penna.,and as more fully described
in Deed Book 698,page 560,Washington County,Penna.,records,
and in Paragraph 6 of the Petition filed at the above number,for
the price or sum of Ten Thousand ($10,000.00)dollars,payable in
cash on the approval of said sale by the Court and delivery of
deed;and it further appearing that George G.Kearns and his wife,
Bessie W.Kearns,of Avella,Penna.,R.D.1,appeared at said
Hearing and desired to bid on said real estate and at an Auction
conducted by the Court,in which Albert Foster participated,the
price offered for said real estate was raised to Seventeen
Thousand ($17,000.00)Dollars,by said George G.Kearns et ux.,
which offer Albert Foster declined to meet;and it further appear-
ing no objections have been filed or better price offered,the
said sale to George G.Kearns and Bessie W.Kearns,his wife,!!
Hereby Approved,and It is Further Ordered that the Register of
Wills and Clerk of The Orphans'Court of Washington County,Pa.,
Russell Marino,execute and deliver a Special Warranty deed for
said real estate as described in pa~agraph 6 of the Petition filed
at the above captioned Number,to the said George G.Kearns and
Bessie Wo Kearns,his wife,upon payment of the full purchase
price made within thirty (30)days from the date of this Decree.
The Administrators of the Louis D.Rush Estate are directed
