SEVENTH:The real estate proposed to be sold was devised to Mary J.Hill for life,with remainder to Jean Haywood and J.Mac Ferris at Item Third of the will,with a provision at Item Fourth that in the event Jean Haywood and J.Mac Ferris failed to pay taxes,insur- ance,maintenance and repairs,the share of the one so failing to pay shall vest in Mary J.Hill absolutely.A copy of the will is attached hereto and marked Exhibit "D". Hill,requested an additional hearing to present the factual matter and testi- mony relative to their claims against this estate. 7.After briefs were submitted by the attorney for the estate and the attorneys for the Department,the Court on February 25,1970.fixed a date for the hearing in this estate for March 26.1970.at 10:00 o'clock A.M. 8.On January 14.1970.Mary J.Hill.who is seventy-six years old.partially blind and nearly deaf.suffered a stroke which paralyzed her left side.She is presently convalescing as a patient at the Washington Manor. 9.Mary J.Hill's interest or claim in the Estate of Margaret F. In this decedent's estate,we have several claims to adjudicate.The Commonwealth of Pennsylvania,Department of Public Welfare,claims the sum of approximately '$2200 because of public welfare payments made to Mary J.Hill,sister-in-law of the decedent,a life tenant under the will, beginning in February,1968. Mary J.Hill claims the sum of $500 which was part of a savings account left by the decedent at the time of her death. The real estate agent who secured a buyer for the property,claims the $500 paid by the prospective buyer as hand money on the transaction. The prospective buyer,who entered into an agreement for the purchase of decedent's real estate,one B. B.Flick,claims the $500 hand money should be returned to him because the sellers were unable to deliver proper title. Decedent died February 11,1968,and letters testamentary were granted March 20,1968,to the executrix,Jean Haywood,a sister of decedent. Soon thereafter it became apparent to the executrix that it would be necessary; to sell the real estate of decedent in order to administer the estate.Conse- quently she secured a Consent for Sale executed by Mary J.Hill,the life • tenant under the will,said consent being dated March 27,1968.We find that the Consent was executed by her when competent. We shall first consider the claim of the Commonwealth as to moneys paid Mary J.Hill by the Department of Public Welfare.The Commonwealth claims that the express conditions of the will of Margaret F.Hill were breached by both remaindermen,Jean Haywood and J.McFerris,sister and brother of the decedent.That by reason of the breach of said conditions,the life estate of Mary J.Hill was enlarged and merged with the fee interest in the estate because the remaindermen's interests automatically terminated on said breach.The Commonwealth therefore claims that it should receive in distribution the sum of $2200,or such other sum as might be presently due,and the balance of the estate should be distributed to Mary J.Hill because of the automatically terminated remaindermen's interests. The Commonwealth makes this claim because of the fact that neither Jean Haywood nor J.McFerris,made any payments whatsoever on account of taiXes,repairs,maintenance,or insurance on the said premises as required by the will. The will of the decedent provided: llParagraph 3.I give,devise and bequeath all the rest, residue and remainder of my estate•••to my sister-in-law, Mary J.Hill,for and during the term of her natural life,and at her death•••to my sister,Jean Haywood and my brother, J.McFerris,their heirs and aSSigns. Paragraph 4.I hereby further direct that my sister- in-law,Mary J.Hill,shall not be liable for the payment of any taxes or the cost of any insurance or maintenance and repair of any real estate of which I die seized during her life tenancy,but that my sister,Jean Haywood and my brother,J.McFerris, shall share the same in equal shares and in the event either or both fail,neglect or refuse to pay his or her share of the same, then and in that event,I give,devise and bequeath his or her share in the remainder of my estate to my sister-in-law,Mary J.Hill,absolutely,upon or at the time of his or her failure, neglect or refusal to do so." -2- ,... It is conceded by the parties in interest that no payments were made by the remaindermen on account of these items.However,it is maintained by the executrix and her brother that it became unnecessary to do so because of the circumstances hereinafter detailed. As already stated,soon after letters testamentary were issued, the executrix began looking for a purchaser for this property and an agreement to purchase was executed by B.B.Flick and his wife,agreeing to pay $10,000 for the property,with a down-payment of $500,which was paid to the agent, Wm.A.Edwards Agency.This was dated April 12,1968,only two months after decedent's death.While it is true that the remaindermen paid no taxes or insurance premiums or maintenance costs,and made no repairs on the homestead of the decedent,these matters must be considered in connection with the totality of the circumstances.The property had already been placed in the hands of a real estate agent for sale;a buyer had been secured at what appeared to be a reasonable price;Mary J.Hill who was living in the home b herself found it inconvenient and almost impossible to continue to live there because of her physical condition and the condition of the premises;she determined to leave the home and di.d so soon after.Should these remainderm n havj:;instituted a series of repairs to bring this old brick house into habitable condition?The house was over 100 years old and admittedly was in serious disrepair.The back porch,which was a first and second floor porch,was actually falling apart and was propped up by braces;the tin roof leaked and was patched with newspapers and tar paper;the house had no running water, no bathroom and the plaster was deteriorated and falling off in many of the rooms;all the windows in the house were dilapitlated,loose and drafty;the heat was secured from a single opening in the floor furnace in the hall.It was plainly apparent that to place this house in habitable condition would require -3- several thousand dollars.If the repairs were made,it would not add substantially to the value of the property when a sale would be consummated. Under all these circumstances it appears to the court that the executrix and her brother probably used good sense in leaving this property as they found it and in securing a buyer. Under the circumstances stated,this court refuses to hold that the remaindermen had permanently breached the conditions of the will and that a fee interest would thereby become vested in the life tenant.We feel that there is not sufficient evidence introduced here to show a permanent breach of conditions by these remaindermen,and the intent on their part,to give up their rights in this property.The claim of the Commonwealth in this respect, as well as the similar contention of the guardian ad litem appointed by the court for Mary J.Hill,is rejected and provisions of the will are declared to be effective presently as to the life tenancy of Mary J.Hill and the interest of the remaindermen in this property. Mary J.Hill has claimed the sum of $500 which she contributed to the decedent1s bank account after she had received said sum from a personal injury claim.The estate does not seriously dispute this claim and we believe that it shoul d be allowed. As to the $500 earnest money deposited by B. B.Flick with the real estate agent,it comes to our attention that the real estate agency is not claiming any of this fund,inasmuch as the property was later sold for the sum of $11,000 and it would appear that the commission is being paid on said sale price. As to the return of the earnest money to B. B.Flick,the court is informed that by stipulation between his counsel and the estate,it is agreed to return the sum of $350 to said B. B.Flick in full satisfaction of this claim. The court hereby approves the stipulation and orders the same paid. -4- .- .. One other matter deserves consideration.The Commonwealth claims that the executrix has paid unnecessary real estate expenses charged to the estate.We feel that all of the expenses incurred were necessary with the exception of the 1968 and 1969 property taxes.These taxes should have been assumed by the remaindermen and should now be paid by them.We note that the said taxes,as charged in the account,amounted to $157.05. It is ordered that these taxes be paid by the remaindermen and that the said sum should be deducted from amounts owing the executrix on her proper commission.She may then be reimbursed for one-half of same by the other remainderman,her brother,J.McFerris.
