PETITION TO SETTLE A SMALL ESTATE
UNDER SECTION 202 OF THE FIDUCIARIES
ACT OF 1949 AS AMENDED
TO THE HONORABLE P.V.MARINO,PRESIDENT JUDGE OF SAID COURT:
The petition of Mary Troncatti,by her Attorneys,
Tempest &Simmons,respectfully represents:
1.That your petitioner,Mary Troncatti,is an adult
individual residing at 770 Cassady Avenue,Monongahela,Washing-
ton County,Pennsylvania,and that she was the wife of Vincent
I)ou.P.Troncatti,who died on the ~~.day of August,1964,in
Monongahela,Washington County,Pennsylvania.
2.That your petitioner and the decedent both resided
at 770 Cassady Avenue,Monongahela,Washington County,Pennsy1-
vania,on the date of the decedent's death and she formed a part
of decedent's household.
3.That the decedent and the petitioner were married
on the 2nd day of July,1938.
4.That the decedent died intestate and on or about
September 7,1966,letters of administration were granted to
petitioner by the Register of Wills of Washington County for
the purpose of litigation in the case of Vincent P.Troncatti
v.Metro M.Smereczniak,at No.17 February Term,1960,in the
Court of Common Pleas of Washington County,Pennsylvania,appeals

in the Superior Court of Pennsylvania at Nos.228 and 283 April
Term,1965,and appeals in the Supreme Court of Pennsylvania at
Nos.9 and 10 March Term,1968.
5.That as a result of the above litigation,a compro-
mise was made awarding petitioner the total sum of $2400.00.
6.That said $2400.00 is the only asset of decedent's
estate.
7.That your petitioner is the only surviving person
entitled to share in said decedent's estate.
8.That out of said $2400.00 the following payments
have been made:
Costs of appeals to Appellate
Courts $115.66
Charleroi-Monessen Hospital 65.00
Dr.Ross E.Richardson 150.00
State Workmen's Insurance Fund,
Commonwealth of Pennsylvania,
reimbursement for medical care 110.70
Miller's Garage,Monongahela,Pa.9.63
F.J.Buckley Insurance Co.,bonds 30.00
Reimbursement to petitioner
for funeral expenses,L.M.Frye 813.00
Attorneys'fees,Tempest &
Simmons and John W.McIlvaine 800.00
$2,093.99
9.That other than the above mentioned debts,there
are no outstanding claims against the estate of the decedent.
WHEREFORE,your petitioner prays your Honorable Couet
to make a decree awarding the balance of the above described
money to your petitioner as her spouse's exemption in accord-
ance with the Fiduciaries Act of 1949,P.L.512,Article II,
Section 211,and she will ever pray.
