Scott died December 5, 1967, and Letters of Administration in his estate were granted to your petitioner on December 12, 1967 by the Register of Wills for Washington County, Pennsylvania •. 2. That vance w. Scott maintained a checking account in the Claysville Office of the Mellon National Bank and Trust Company in which there was a balance at the date of death of $7,600.04. 3. That D. G. Re,nolds, of R. D. #2, Claysville, Pennsylvania, claims said ac- count as his sole property under a joint account. 4. That the-deceased placed Mr. Reynold'l name on the account solely as a con- venience and in order to see that his bills were paid at a time when the deceased was hospitalized. 5. That D. G. Reynolds claims the agreement he had with Vance w. Scott was that he should pay the hospital expenses, the funeral expenses and the opening of the grave. 6. The funeral bill at the Brownlee Funeral Home was paid by D. G. Reynolds by his individual check, and in return he claimed and received the Social Security benefits~ 7. At all times the deceased treated the bank account as his own individual pro- perty. WHEREFORE, your petitioner prays your Honorable Court to issue a citation, direct- ed to D. G. REYNOLDS, to show cause why he should not deliver to the Administratrix of the Estate of VANCE W. SCOTT the balance in the account, after paying the funeral and hospital bills. Carter, of record in the Office of the Register of Wills of Washington County in Will Book 114, page 401, which reads as follows: " I give, devise and bequeath all the residue and remainder of my estate of whatever kind and wheresoever situate to D. Gaylord Reynolds and Freda C. Reynolds, his wife, sharing as tenants by the entireties." And said 1/16 interest was so awarded to said D. Gaylord Reynolds and Freda C. Reynolds, his wife, by the Adjudication and Decree in the Estate of Wray W. Carter, deceased, dated October 11, 1973, . - at·No. 63-72-872. 5.
