Mon Valley Young Men's Christian Association,a Non-
profit corporation organized under the ~ws of the Commonwealth
of Pennsylvania,having its principal office in the Borough of
Charleroi,Washington County,Pennsylvania,hereby through its
counsel,the undersigned stipulates as follows:
1.That it is a Principal Beneficiary under the Estate
of L.R.Kinder,a/k/a Leslie R.Kinder,deceased,late of Speers•
Borough,Washington County,Pennsylvania,whose duly probated
Last Will and Testament is of record in the Office of the Register
of Wills of Washington County,Pennsylvania.
2.That it is also a Principal Beneficiary under a
certain "IRREVOCABLE TRUST AGREEMENT,CI dated December 14,1964,
wherein the decedent is referred to as the "DONOR,"and a copy of
which Agreement is attached to the Election filed at the above
number by Emma G.Kinder,widow of L.R.Kinder,a/k/a Leslie R.
Kinder,deceased,to take against the said Agreement under
Section 11 of the Pennsylvania Estates Act of 1947 as amended,
as well as against the said Last Will and Testament of her late
husband.

3.That the Mon Valley Young Men's Christian Associa-
tion,as such Principal Beneficiary under the above mentioned
Will as well as the above mentioned Agreement,does hereby
incorporate by reference all those matters set forth in an
instrument titled "PARTIAL RETRACTION OF ELECTION BY SURVIVING
SPOUSE,"and hereby acknowledges to have received from the said
Emma G.Kinder,an executed copy of said instrument titled
"PART.IAL RETRACTION OF ELECTION BY SURVIVING SPOUSE,"wherein
the said Emma G.Kinder retracts her Election with respect only
to the said "IRREVOCABLE TRUST AGREEMENT,"above mentioned,
and which said Partial Retraction does not in any wise affect
her said Election against the Last Will and Testament of her late
husband•.
4.That since up to the present time,no interest of
any party in interest under the said "IRREVOCABLE TRUST AGREE-
MENT"has been affected or prejudiced by the said Election,the
Mon Valley Young Men's Christian Association takes no exception
to this Partial Retraction and approves the same and joins in
the prayer of the Petition of the said Emma G.Kinder to the
Orphans'Court of Washington County,Pennsylvania,that said
Partial Retraction by approved and ordered to be filed.

1.That she is the widow of L.R.Kinder,a/k/a Leslie R.
Kinder,who died testate on February 14-,1968,a late resident of the
Borough of Speers,this County,and that his Last Will and Testament,
dated the 12th day of June,1967,was duly probated on the 27th day
of February ,1968 in the Office of the Register of Wills of

1.That it is the duly appointed Executor of the Estate of
L.R.Kinder Kinder,a/k/a Leslie R.Kinder,deceased,late of Speers
Borough,washington County,Pennsylvania,whose duly probated Last
Will and Testament is of record in the Office of the Register of Wills
of Washington County,Pennsylvania.
2.That it is also the duly constituted Trustee in a certain
"IRREVOCABLE TRUST AGREEMENT',dated December 14-,1964-,wherein the
decedent is referred to as the "DONOR",and a copy of which Agreement
is attached to the Election filed at the above number by Emma G.Kinder
widow of L.R.Kinder,a/k/a Leslie R.Kinder,deceased,to take
against the said Agreement under Section 11 of the Pennsylvania Estates
Act of 1947 as amended,as well as against the said Last Will and
Testament of her late husband.

to the said ffIRREVOCABLE TRIST AGREEMENT ff ,above mentioned,and which
said Partial Retraction does not in any wise affect her said Election
against the Last Will and Testament of her late husband.

my said late husband,who died testate,his Last Will and Testament bearing dat
of June 12,1967,was duly probated in the Office of the Register of '.1ills of

Book Vol.105,Page 299,at which time Pittsburgh National Bank was duly appoin
ed as Executor;
AND WHEREAS,I,Emma G.Kinder,the undersigned,following the probate
of my late husband's Will as aforesaid,did on the advice of the said Victor E.
Riva elect in writing,in compliance with the applicable Acts of rlssembly,to
take against the said'iill and to share in my late husband's estate in the same
fashion and luanner as though he had died intestate;
