PETITION 'TO FIX BOND
TO THE HONORABLE PRESIDENT JUDGE OF SAID COURT:
The petition of Thomas J.Finley respectfully
represents:
1.That Mary F.Cotterrel died November 9,1967,a
resident of the Borough of Claysville,Washington County,Pennsyl
Vania,leaving her Will dated April 17,1956.
2.That Letters of Administration c.t.a.were
granted to your petitioner on February 20,1968,by the Register
of Wills of Washington County,Pennsylvania.
3.That an Inventory was filed on December 30,
1968,showing a personal estate of $2,267.60 and the real estate
which is the subject of this petition valued at $4,650.00,a
copy of said Inventory being attached hereto,made a part hereof
and marked Exhibit "A".
4.That at the time petitioner applied for Letters
of Administration c.t.a.,he posted surety bond in amount of
$2,000.00 with Travelers Indemnity Company as surety.
5.That your petitioner has entered into an agreeme,t
to sell the real estate of decedent,being Lot No.6 in Birch's
Subdivision to the Borough of Claysville as more particularly
described in copy of Article of Agreement attached hereto and
made a part hereof and marked Exhibit "B",to Howard C.Fisher
and Olive J.Fisher,his wife,for $4,650.00.
6.Attached hereto and made a part hereof as
Exhibits "c"and "D"are affidavits of two responsible persons
familiar with real estate values stating the fair market value
of the property proposed to be sold.
WHEREFORE,petitioner prays Your Honorable Court
under Section 541 of the Fiduciaries Act of 1949 and Orphans'
Court Rule No.16 to fix the amount of additional bond to be
filed to consummate said sale.

Between THOMAS J.FINLEY,Administrator c.t.a.of Estate of Mary F.Cotterrel,
late of Borough of Claysville,Washington County,Pennsylvania---------------
---------------------------------------------------(hereinafter called "Seller")andHOWARDC.FISHER and OLIVE J.FISHER,his wife,of Amwell Township,Washingtor
County,Pennsylvania-------------------------------(hereinafter called "Buyer"),
WITNESSETH,that for the consideration hereinafter set forth and intending to be legally bound the Seller and
Buyer mutually agree as follows:.
1.Seller agrees to sell and convey to buyer on or before January 2,1969
by Trustee's warranty deed in fee simple absolute,clear of all mortgages,judgment liens
and tax liens and other'encumberances affeCting its marketability (except as hereinafter set fOJ:th)all the real property
described in Paragraph 7 hereof..
2.Buyer agrees to purchase said real property and to pay Seller therefor the sum of Forty six
hundred fifty and no/lOO-----($4,650.00 )Dollars as follows:the,sum of $250.00
on execution of this agreement,receipt whereof is hereby acknowledged,and
the balance of $4,400.00 on delivery of deed on or before January 2,1969..,
3.Possession shall be given on delivery of deed x~x ,and settlement shall be made

Buyer is given permission to enter upon said property for the
purpose of making needed repairs.
,4.At settlement Seller shall pay for or be charged with the cost of all federal documentary taxes and
state and local realty transfer taxes payable upon this transaction,but real estate taxes for year of settlement,sewer
charges and rents and royalties shall be prorated on a calendar year basis between Seller and Buyer as of date of
delivery of possession of the premises;except as hereinafter set forth:
Seller pays all property taxes for 1968 and transfer taxes on the
deed.
5.From and after the date of this agreement,insurance shall be provided and paid for as follows:
Seller shall maintain present fire insurance but Buyer may procure
additional insurance to protect their interest.
6.Time is of the essence of this Agreement.
7.The real property which is the subject of this Agreement is described as follows:

BEING Lot No.6 in Birch's Subdivision or addition to said Borough
of Claysville,Washington County,Pennsylvania,and bounded and described

by Elm Street and on the West by Lot No.7.Said lot beina 35 feet on Elm
Street and extending back of even width 155 feet to a 16 foot Alley.
BEING the same as conveyed to Mary F.Cotterrel by deed of Gai~E.
Axtell,single,dated October 13,1923 and reco~ded in the Recorder's Office
for Washington County,Pennsylvania,in Deed Book 535 page 646.The said
Mary F.Cotterrel died November 9,1967,leaving her Will dated April 17,
1956 which is filed in the Office of the Register of Wills for said County
in Will Book 105 page 284 •Letters of Administration c.t.a.thereon were
issued to Thomas J.Finley.by said Register.of Wills on February 20,1968~
