PETITION UNDER SECTION 1201
OF THE FIDUCIARY ACT OF 1949 TO DECLARE
PRESUMED DECEDENT
1.Your Petitioner is Raymond Yeager who resides at
603 Orchard Avenue,North Charleroi,Washington County;
Pennsylvania.
2.This petition is filed to establish the death of
Glen Yeager,hereinafter called Absentee.
3.The last known address of the Absentee was at the
residence of his mother,Beatrice Yeager,at 627 Center Avenue,
North Charleroi,Washington County,Pennsylvania,and from and
since the 1st day of November,1958,no further specific address
has been knowD..
4.From the date averred in the preceding paragraph,
•
down to the present date,the Absentee has been absent from hiso
place of residence without being heard of.Your Petitioner,his
brothers and mother have diligently attempted to discover the
•
whereabouts of the Absentee but have been unable to ascertain his
residence or whereabouts.
5.The last inquiry or information received by your
Petitioner was from his brother,Bruno Yeager,who was able to
discover that the Absentee was arrested for vagrancy in San Diego,
California,on December 31,1958.
6.Your Petitioner,his brothers and mother have tried
in the following manner to attempt to locate the Absentee:
(a)Letters
(b)Inquiry among mutual friends
(c)Personal investigation by family members
who have journeyed to the West Cpast.
(d)Inquiry of police departments in major
cities.
(e)Advertisements in Los Angeles city news-
papers.
7.Your Petitioner believes that the Absentee has died
because more than seven years have elapsed since he was last
heard of.
8.Your Petitioner is interested in the estate of the
Absentee because the Absentee was one of six ehi1dren of John
Yeager who died testate,leaving a Last Will and Testament of
record at Will Book 99,Page 578,of the County of Washington,
under the terms of which there wa.s a final award made giving the
Absentee a one-sixth interest in certain real estate.Attached
hereto is a copy of the said Last Will and Testament and Award of
Orphans'Court.
9.The only party interested in the estate of the de-
cedent is his mother,Beatrice Yeager,who,under the intestate
laws of the Commonwealth of Pennsylvania,is entitled to all of
his assets.The presumed decedent or Absentee,however,has the
following named brothers at the addresses set forth:
Bruno Yeager,6750 Hidden Hills Drive,Cincinnati,
Ohio.
Raymond Yeager,603 Orchard Street,North Charleroi,
Pennsylvania.
A1do Yeager,115 N.Catalina Street (Apt.1),Los
Angeles,California.
Quentin Yeager,R.D.111,Charleroi,Pennsylvania.
Cleo Yeager,R..D.#1,Craven Drive,Charleroi,
Pennsylvania.
10.All parties in interest are adult and there exists
no necessity for the appointment of a Fiduciary for interests un-
represented.
11.There is attached hereto and made a part hereof a
joinder in this petition,together with a waiver of notice of
all such parties in interest.
WHEREFORE,your Petitioner requests your Court,pursuant
to Section 1201 of the Fiduciary Act of 1949,P.L.512,20 P.S.
1201,to decree that the Absentee is dead and the date of his
death.

DISCUSSION AND DECREE
Marino,P.J.May 17,1968.
This matter comes before the Court upon petition for hearing and
for a decree of presumption of the death of Glen Yeager,as provided by the
Act of April 18,1949,P.L.512,Section 1201,20P.S.320.1201.This
Court fixed a time for hearing,and directed notice as required by law and by
court rules.Proof of service of the required notices,including the publicatio
required by law,was presented in open court on the day appointed.Said pape s
were ordered filed.
On the day appointed,Monday,April 8,1968,at 11:00 o'clock A.M,
E.S.T.,testimony was taken by the Court.All known parties in interest wer
properly notified,and the petitioner,Raymond Yeager,was represented by
counsel,Lloyd Woodward,Esquire.The proceedings appeared to be regular
in all respects and i'nsubstantial compliance with the Act of Assembly pertaini g
to such cases;this Court then proceeded to take testimony,and from the
testimony so taken,and the pleadings,the hearing judge makes the following:
FINDINGS OF FACT
1.The persons interested in this proceeding are the petitioner,
Raymond Yeager,a brother of the presumed decedent;Bruno Yeager,of
Cincinnati,Ohio,a brother;Aldo Yeager,of Los Angeles,California,a
brother;Quentin Yeager,of Charleroi,Pennsylvania,a brother;Cleo Yeager,
..
of Charleroi,Pennsylvania,a brother;Beatrice Yeager,of Charleroi,
Pennsylvania,his mother;and Glen Yeager,the subject of this proceeding.
2.All the interested parties are sui juris.
3.Glen Yeager was a son of John Yeager,now deceased,and
Beatrice Yeager,who is still living.Glen Yeager is about 55 years of age.
4.Glen Yeager has been absent and unheard of from December 31,
1958,thence hitherto.Glen Yeager has not been heard of since that date.HE
was a'permanent resident of the Borough of Charleroi,Washington County,
Pennsylvania,which place was his legal domicile and from which he has been
absent from such permanent place of residence and domicile since November ,
1958.
5.Glen Yeager was a veteran of World War II and had received an
honorable discharge from the service.He was employed in the State of
California,for several years after his discharge from the service in 1945
and had lived with a brother,Aldo Yeager,in the State of California,until
the summer of 1958,when he returned to his home and lived with his parents,
John Yeager and Beatrice Yeager in Charleroi,Pennsylvania,until the date
of his disappearance.A diligent search has been made for the said Glen
Yeager but to no avail.Inquiry was made among mutual friends.Personal
investigation by family members was made,some of whom journeyed to the
State of California to inquire about his whereabouts.The police departments
of the major cities were consulted,and advertisements were placed in the
Los Angeles and San Diego City newspapers.All of said investigations merel~
disclosed that on December 30,1958,Glen Yeager had been arrested by the
police on a charge of vagrancy in the City of San Diego,California.He has
not been heard of or from since said date.No person has heard from the said
Glen Yeager since December 30,1958,either directly or indirectly and no onE
has seen him since said date nor has been ab Ie to determine his whereabouts
since said date.

6.All the parties interested in this proceeding have been properly
notified thereof,and the subject matter of this proceeding is properly ·within
the jurisdiction of this Court.
7.Glen Yeager died seized of certain interests in real property,
to wit,a one-sixth undivided interest in a certain tract or parcel of land
situate in the Borough of North Charleroi,Washington County,Pennsylvania,
and certain personal property,inherited from the estate of his father,John
Yeager.
8.The record does not disclose the exact date of birth of Glen
Yeager,but the testimony indicates,that if living,he would presently be of
the age of 55 years.On the date of his disappearance,he was unmarried and
had no issue.There is no knowledge of any will which he left.
9.Glen Yeager had lived with his parents in the Borough of North
Charleroi,Washington County,Pennsylvania,and that was his permanent
domicile.
10.On December 31,1958,the date of his final disappearance,
and likewise on December 31,1965,or seven years thereafter,the heirs
and next of kin of said Glen Yeager consisted of his mother,Beatrice Yeager,
and his brothers hereinabove named.
11.Since the circumstances surrounding the disappearance of Glen
Yeager present no indication of a specific peril or any other immediate danger
the said Glen Yeager is presumed to have lived for a period of seven years
from the said date of his final disappearance,to wit,llntil December 31,1965
12.Glen Yeager is presumed,in fact and in law,to be dead,
intestate,unmarried,and without is sue.
13.Glen Yeager is presumed,in fact and in law,to have died
December 31,1965.

1.Glen Yeager is presumed,in fact and in law,to be dead,
intestate,unmarried and without issue.
2.The date of death of Glen Yeager is determined to be
December 31,1965.

JUDGE OF SAID COURT:
1.That Glen Yeager,residing at a last known
address of 627 Center Avenue,North Charleroi,Washington County,
Pennsylvania,died intestate,unmarried and without issue on or
about December 31,1958.
2.That at No.299 of 1968,Orphans'Court,a
proceeding for the purpose of establishing the decedent as a
presumed decedent was entertained and a final decree thereon
handed down on May 17 ,1968.
3.Following the proceedings set forth hereinabove,
Letters of Administration were granted to Raymond Yeager on
r 7 ,:1968.
4.That the total inventory of the assets belonging
to the decedent as fully accumulated and of which the Petitioner
has full and complete knowledge consists of only the real estate
which is hereinafter described in Exhibit A and valued at $5,000.O.
5.That security has been entered by your Petitioner
with the Register of Wills in the amount of $10,000.00 with the
United States Fidelity and Guaranty Company as surety on the bond.
6.Your Petitioner believes it would be in the
best interest of the estate to sell the premises described in
Exhibit "A"and,accordingly,there is joined in this petition
Beatrice Yeager,who is the life tenant of the premises.
7.The decedent acquired his interest under and
by virtue of an Award of the Orphans'Court of Washington County
at No.152 of 1966 A.A.It is a fractional interest,being a
one-sixth of the total premises,subject to the life estate
aforesaid.
8.All of the other parties having an interest in
the estate have signed an agreement and join in execution of the
deed,a copy of which is hereby annexed and which is a true and
correct copy.
9.That the one-sixth share of the decedent to which
the decedent is entitled is in the amount of $833.33,less costs,
taxes and commission.
10.There are no liens of record,mortgages,
delinquent taxes or judgments against the premises of any kind
or nature.
11.The name and relationship of all parties in
interest is Beatrice Yeager,Mother of the decedent,who resides
at 627 Center Avenue,North Charleroi,Pennsylvania.
WHEREFORE,your Petitioner prays your Honorable
Court under Section 541 of the Fiduciaries Act of 1949 to waive
the fixing of additional security and upon entry of which order yo r
Petitioner shall have authority to receive the proceeds of sale
of the premises aforesaid.
