PETITION FOR CLAIM FOR FAMILY EXEMPTION UNDER SECTION 211 OF THE FIDUCIARIES ACT OF 1949 AS AMENDED The Petition of MARTHA L.BAILEY,by her attorneys,Tempest &Simmons,respectfully represents: 1.That your Petitioner,Martha L.Bailey,is an adult individual residing at 226 Union Street,Monongahela,Washington County,Pennsylvania,and that she was the wife of the Decedent, James Bailey,who died on the 20th.day of November,1967,in Monongahela,Washington County,Pennsylvania. 2.That your Petitioner and the Decedent,both resided at 226 Union Street,Monongahela,Washington County,Pennsylvania, on the date of Decedent's death,and that she formed a part of Decedent's household. 3.That the Decedent and your Petitioner were married on the 10th.day of February,1922,at Wellsburg,West Virginia. 4.That the Decedent died intestate and no letters of administration have been granted by the Register of Wills of Washington County,Pennsylvania,nor will any be requested in the administration of this Estate. 5.That the said James Bailey left him surviving the TEMPEST &SIMMONS SECOND 8<CHESS STS. MONONGAHELA.PA. following persons entitled to a share in his estate: (1)Martha L.Bailey,the wife of the Decedent, who resides at 226 Union Street,Monongahela, Washington County,Pennsylvania. (2)James Bailey,Jr.,the son of the Decedent, who resides at 48 Thornton Street,Portsmouth, New Hampshire,and who is 45 years of age having been born on June 19,1922. 6.That your Petitioner is entitled to the family exemption as the wife of the Decedent and is the only person who formed a part of the Decedent's household at the time of his death. 7.That the only asset in the Decedent's estate is cash in the amount of $367.28,being a savings account in the Pennsylvania Railroad Loan Association,whose address is Room 215,15 North 32nd.Street,Philadelphia,Pennsylvania,19104, and a death benefit in the amount of $250.00 payable to the widow of the decedent. 8.That there are no outstanding claims or debts against the estate of the decedent and your Petitioner has paid all the bills of the decedent,including a funeral bill in the amount of $1,247.00,which payment was made to the Bebout &Yohe Funeral Home of Monongahela,Washington County,Pennsylvania. WHEREFORE,your Petitioner prays that the Court direct the Pennsylvania Railroad Company to pay the death benefit in the amount of $250.00 to Martha L.Bailey,and the Pennsylvania 2. TEMPEST a SIMMONS SECOND II CHESS STS. MONONGAHELA.PA. Railroad Loan Association,of Philadelphia,Pennsylvania,to pay the amount of the savings account to Martha L.Bailey,as part of her family exemption,as is required by law. TEMPEST &SIMMONS 3. DEC R E E 9f!LANDNOW,this ~ay of February,1968,upon consideratio of the foregoing Petition,distribution of the personal property of which James Bailey died possessed,is hereby ordered and decreed to be made to his widow,Martha L.Bailey,and more specifically it is directed that the insurance proceeds in the amount of Two Hundred Fifty ($250.00)Dollars and the savings account in the amount of Three Hundred Sixty-Seven and 28/100 ($367.28)Dollars held by the Pennsylvania Railroad be paid to Martha L.Bailey,who is hereby authorized to receive,collect and distribute the property as set forth in the Petition.
