PETITION FOR SETTLEMENT OF SMALL ESTATE
To the Honorable,the President Judge of the said Court:
AND NOW,comes FLORENCE M.TOMKO and petitions your
Honorable Court,as follows:
1.She is the Execuh~ixof Howard A.Tomko,deceased,as will
appear from Letters Testamentary,which were granted to her by the
Register of Wills of Washington County,Pennsylvania,on February 5,1968.
2.The said Howard A.Tomko,at the date of his death,on January
11,1968,resided at 6209 Willow Street,Finleyville,Washington County,
Pennsylvania.
3.The said Howard A.Tomko,died possessed of no assets except
personal property in the amount of $300.00.

4.The said decedent executed a Will,which has been duly pro-
bated in the Office of the Register of Wills of Washington County,Pennsyl-
vania1 and of which a true copy is attached hereto and marked Exhibit "A".
5.There are no creditors of the decedent.
WHEREFORE,petitioner prays your Honorable Court to direct the
distribution of the aforesaid estate to her as the sole devisee under the Will
in partial satisfaction of her family exemption.

LAST WILL AND TESTAMENT OF HOWARD A.TOMKO
I,HOWARD A.TOMKO,of Union Township,Washington County,
Pennsylvania,being of round and disposing mind and memory,
do make,~ublish and declare this my Last Will and Testament,
hereby revoking any and all other wills by me at any time here-tofore made,viz.:
FIRST.I direct that all my just debts and funeral expenses
be paid as soon as praotioable after my decease.
SECO~~.All of my estate,real,uersonal and mixed of
whatsoever kind and nature and wheresoever situate,I gIve,devise
and bequeath unto my wife,Florence M.Tomko,her heirs andassigns,forever..
..THIRD.Should my said 'wife predecease me,I give,devise
and bequeath a~l of my estate,real,personal and mixed,of v.hat~
soever kind and nature and wheresoever situate,unto my two children,
Marilyn Tomko Miller and Larry H.·Tomko,share and shs.rs alike,
their bolis and asslgns~forever.
FOURTH.I hereby nominate,constitute and ap~oint my wife,
Florenoe M.Tomko,Exeoutrix of this my Last Will and Testament.
Should my said wife ~redeoease me,I hereby nominate,constitute
and appoint my daughter,Marilyn Tomko Miller,Exeoutrix of this
my Last Will and Testament.

ORDER
,1968,on consideration of the
within Petition,the same is approved nd Florence M.Tomko,Executrix of
the Estate of Howard A.Tomko,deceased,is directed to pay to herself as
the sole devisee of the said decedent the sum of $300.00,being the entire
estate of the decedent.The family exemption being properly allowable and
exceeding in amount the total of the estate,no transfer and inheritance tax
is due or payable.
