PETITION FOR SETTLEMENT
OF
SMALL ESTATE
TO THE HONORABLE PRESIDENT JUDGE OF SAID COURT:
The petition of Hazel D. Miller, respectfu1ly represents:
1. The decedent, Edgar M. Miller, died January 5, 1968,
at 8:45 o~clock A.M. at the Ohio Valley General Hospital at
Wheeling, West Virginia. At the time of his death, he was a
resident of Donegal Township, Washington County, Pennsylvania.
2. At the time of Decedent's death, the only assets of
his estate consisted of a 1960 Rambler Sedan bearing Serial Number
Bll9145 and registered with the Commonwealth of Pennsylvania as
Certificate of Title No. Fl3583754 valued at $ 200.00 ~~~~---------
3. The Decedent left his Last Will dated December 6, 1954,
the original of which is attached herewith and made a part· hereof,
wherein he bequeathed all the residue of his Estate unto his
widow, Hazel D. Miller, your petitioner, who resides at R. D. #2,
West Alexander, Pennsylvania.
4. There are no creditors of said decedent. Decedent's
burial was conducted by Ferrell Funeral Home at West Alexander,
Pennsylvania, and the cost of said burial was paid by your peti-
tioner.
5. Attached hereto and made a part of this petition is
a true and correct appraisement of the 1960 Rambler Sedan owned by
Decedent at the time of his death.
WILL
I, Edgar M. Miller, of Donegal Township, Washington County, Pennsyl-
vania, do make and publish this my last will and testament, hereby revoking and
annulling any and all wills by me at any time heretofore made.
1. I direct my Executor hereinafter named. to pay all my just debts
and funeral expenses as soon after my decease as convenient.
2. All the rest:·, residue and remainder of my estate, real, personal
and mixed, I give, devise and bequeath to my wife, Hazel D. Miller,in the event
that she survives me and it is my request that whatever is left thereof that
she shall divide the same among our children.
3. In the event that my wife, Hazel D. Miller, should predecease me
then I give, devise and bequeath all the remainder of my estate to my children
to each share and share alike •
• ' . 'I hereby nominate, constitute and appoint my wife, Hazel D. Miller,
Executor of this my last Will and Testament·and in the event that she should
predecease me or is unable or refuses to execute this Will then I nominate,
constitute and appoint my son, Eaymond M. ~iller, Executor.
Witness my hand and seal this~~ day of December, 1954.
Signed, sealed, published and declared by the Testator, Edgar M.
Miller, to be his last Will and Testament in the presence of us, who at his
request, in his presence and in the presence of each ~ther, have hereunto set
our names as subscribing witnesses.

WHEREFORE, petitioner prays Your Honorable
Court to award said 1960 Rambler Sedan to her pursuant to the
Will of said Decedent without the necessity of filing an Inventory
or appraisement.

law deposes and says that the facts set forth in the annexed

D E C R E E ~~ AND NOW THIS ~day of SaBHary~ 1968, upon
consideration of the annexed petition and upon motion of Sherman
H. Siegel, attorney for petitioner, pursuant to Section 202 of
the Fiduciaries Act of 1949, it is ORDERED AND DECREED that Hazel
D. Miller make distribution of the assets of said Estate without
administration and the same consisting of a 1960 Rambler Sedan
bearing Serial Number Bll9145 and Pennsylvania Certificate of
Title Number Fl3583754 is awarded to the said Hazel D. Miller
pursuant to the terms of Decedent's Will. A certified copy of
this Decree shall constitute sufficient authority to the
Pennsylvania Department of Revenue to transfer the title to said
automobile.
