That your petitioner was the ancillary executor of the estate of Charles Ellis Lilley, deceased. 2. The estate of Charles Ellis Lilley, (who was a resident of Bluefield, West Virginia, at the time of his death), included realty in the County of Washington, Pennsylvania. An inventory and appraisement was filed in the Register of Wills Office of Washington County, Pennsylvania, a copy of said inventor~ being attached to this petition. 3. The inventory was incorrect in that the mining rights appurtenant to the Freeport vein of coal set forth in the . inventory and appr ai:seme11::t '·were inadvertently omit ted. 4. That, at the request of Tom Lilley, son of Charles Ellis L~lley;· who purchased the said realty from the ancillary executor, an amended inventory has been prepared and exe- cuted by your petitioner, and it is desirous to obtain permission and authority to file the said amended inventory and appraisement, as the estate was audited and closed on May 27, 1968. The purpose of filing the said amended inventory and ap- praisernent is to clear the title to the ownership of the mining I \ rights which were appurtenant to the said Freeport vein of coal.
