Buchanan, son and residuary legatee of decedent, is filed herewith. Generally speaking, eince the "Inheritance and Estate Tax Act of 1961", Pa. Inheritance Taxes are paid from the residue in the absence of a contrary intent appearing in the will. However, Mr. Galante suggests that the inheri- tance tax on the Trust Estate given to Mellon Bank for the benefit of grand- son is governed by 72 P.S. Sec. 2485-718 (b) and the tax should be paid from the Trust Estate either by Accountant or the Trustee.
