TRASATTI, .Deceased. No. 167 of 1968 ADJUDICATION Marino, P. J. July _{_, 1968. We have here two separate claims against decedent's estate. The first is that of Albert Pauline for $20,000. He allegedly loaned Mr. Trasatti said sum in the month of December, 1956. They were associate in the operation of the Bentleyville Amusement Company, in this county. Mr. Joseph F. Chiurazzi, a former accountant, was the only witness to testify concerning the matter of the alleged loan. He kept the complete records for both individuals. On c:ross-examination he was asked (Testimony-p. 9): "Q Now this $20,000 (you prepared the book~), where did the money go? A The $20, 000 was never shown on the books. What happened to it, I do not know. 11 '='he witness further testified (T. -p. 10): "Q Now you say this $20,000 passed hands in front of you in 1956, 12 years ago? A Yes. Q And nothing was said in front of you, Mr. Chiurazzi, as to what it was for ? A That's right." c ·-' . . ; . < Mr. Chiurazzi, who'had prepared their complete business records over a period of almost 10 years, had no idea what the alleged transaction was for. He merely saw Mr. Pauline pass over to Mr. Trasatti the sum of $20, 0 He did not state whether it was in cash (currency), bonds, securities or just what form it was in, although he answered a question of counsel and said he w;3,s "present" when the transaction took place, and counsel used the term "money11 in his question (T. -p. 5). The testimony developed that Mr. Pauline was in prison during part of the years 1959 and 1960; that during that time, Mr. Trasatti made available to Mr. Pauline's wife, on a weekly basis, the total sum of approximately '$10, 000. Mr. Trasatti' s son-in-law testified that the reason for giving her this large sum was that "they conducted the lottery business and one had to take care of the other. tt The testimony as a whole is of the most general character. The reason is obvious. If there was an illegal operation being conducted, the less said the better. But we will not relax our standard of proof required in order to accommodate such a contingency. The burden remains the same. Claims against a decedent's estate can be established only by evidenc which is clear, direct, precise and convincing: SecanT Estate, 407 Pa. 162, J.64 (1962); Gadola Estate, 410 Pa. 250, 252 (1963). This rule applies with even greater strictness when the claim is of long standing and stale: Landis v. Roth, 109 Pa. 621, 624 (1885); Scott's Estate, 311 Pa. 145, 147 (1933). In Godola Estate, supra, the Court said (at page 252): "We have consistently ~1.eld that claims against a decedent's estate are viewed with suspicion when they could and ordinarily would, if genuine, and reasonable time permitted, have been made in decedent's lifetime; and that all claims against a decedent's estate must be proved by evidence which is clear,' direct, precise and convincing." -2- c 0 In the subject case, if the debt as alleged was contracted in 1956, it was 10 years old at the time of decedent's death, and certainly must be viewe as a ttstale claim". We are compelled to look upon such claims with just suspicion: Mueller's Estate, 159 Pa. 590 (1894); Conrad's Estate, 333 Pa. 561 (1938). We hold that claimant has failed to prove his claim by the standard of evidence required by our decisional law. It is therefore dismissed. The. next claim is that of Catherine Hadjantoni. She worked as a bookkeeper for Mr. Trasatti during a period of many years. She at times leaned him money when needed in his business. One of her witnesses testified that she loaned Mr. Trasatti the sum of $800 on one occasion. The same witness testified that the decedent admittE that he owed Kay {Catherine) "a good bit of money, 11 but this appears to be with respect to borrowed funds .. She testified (page 17): "I can remember one time when he was hard hit for the machines over numbers and he borrowed money from her to pay his debts. And he said he owed Kay a good bit of money. 11 The fact that claimant was to be paid $75 per week for her work was definitely hearsay evidence. No oral or written contract was proved. Though she had worked for decedent for probably ten years, she could produce nothin in the way of employment records, or tax records, or records of any kind to indicate such employment. Mr. Albert Pauline, a sometime associate of decedent, testified that claimant was paid by decedent "when he had the money", indicating that the r;ayments were not regularly made. He recalled that he brought her $600 pay from decedent in December, 1958. Claimant herself testified about two -3- I I-· "' -· ' . payments of $100 each that were sent to her by decedent, the first being in January, 1967, and the second in June, 1967. But he died December 9, 1966, so that if such payments were made, it was not at the direction of decedert . However, our biggest difficulty in this case is attempting to fix the amount due claimant on account of her employment, and the amount due, if any, on account of money borrowed by decedent. Any amount we would fix would be pure speculation. There is no competent testimony whatever concerning the amount of back pay due the claimant. The fact that $600 was paid in 1958 and a further sum of $200 after decedent's death does not help us in any manner. Not even the payment of the '$200 after death is any indication of any money due, as it is not an admission of decedent that any money was owing. The same may be said of any indebtedness claimed to be owing the claimant. The fact that at one time there was an indebtedness of at least $800 due her would in no way help us establish an existing debt at date of death.
