PETITION TO APPROVE SALE
TO THE HONORABLE P. V. MARINO, PRESIDENT JUDGE OF THE SAID COURT:
. The Petition of Margaret H. Kline respectfully represents:

Charles Randall Hooe; Sr., died intestate on June 10, 1953, leaving
to s~r~ive him as his sole heirs at law his widow, Margaret Hooe, and a son,
Charle~ Randall Hooe; Jr.

Charles Randall Hooe, Sr., died seized of certain real property
situat~ in the City of Washington, Washington ~ounty, Pennsylvania, being more
fully described as follows:
ALL that certain lot or piece of ground situate on
Highland Avenue in the City of Washington, Washington
County, Pennsylvania, bounded and described as follows,
to wit: -
BEGINNING at a point where the East line of property
late of Dr. Fulton Estate, intersects the North side of
Highland Avenue; thence along the line of said Avenue North
46 1/2° East, 78 2/3 feet, more or less, to the line of lot
now or late of John Brown; -t;~ence along said line .N.orth
43 1/2° West, 149 feet and 9 inches, more or less, to a
point on the line of lot Jate of Fulton Estate; thence
along the line last mentioned South 15 l/4° East 168 feet
and 9 inches, more or less, to the place of beginning.
And also the right of way along a certain alley, 11
feet wide and running back 115 feet; together with the
extension of said alley as shown in Deed Book 5R, page 577,
which said right of way was conveyed by Dr. Samuel Fulton,
now deceased, and also the right to keep open a drain from
the cellar of the property hereby conveyed into the lot late
of Mrs. Isabella Evans of the South side of Highland Avenue.

By virtue of the intestate laws of the Commonwealth of Pennsylvania,
the said Charles Randall Hooe, Jr., inherited one-half (1/2) 0£ the said real
estate and Margaret Hooe inherited the other one-half (1/2).

The said Charles Randall Hooe, Jr., was born on May 28, 1950; and
is therefore incapable of executing any deed for the sale of said real estate,
blt on December 26, 1967, your p~titioner was appointed guardian of his estate
b~ order of the Probate Court of Jefferson County, Ohio, at proceedings in the
P~obate Court at No. 57286, a copy of which is attached hereto.

Your Petitioner has agreed with Blaine Beeghley to sell said real
estate tolhim for the sum or consideration of Twelve Thousand and no/100
(~12,000.00) Dollars.

That your petitioner, as guardian of the Estate of Charles Randall
Hboe, Jr., requests your Honorable Court to approve the sale of his one-half
(1/2) interest and authorize and empower her to make and execute a deed
transferring the said minor's interest.

Your petitioner is a resident of the State of Ohio; as is the minor,
Charles Randall Hooe, Jr.

Attached hereto are two affidavits of two competent persons to the
effect that the offered price at the proposed private sale is greater than
could be obtained at public sale, being marked Exhibits "A" and "B", respective

Attached hereto is a certificate of the assessed valuation of the
: said property for tax purposes, marked Exhibit "C".

. The proceeds due the said minqr will be:held by your petitioner, as
guardian and audited and di~p~~ed of by the Probate Court of Jefferson County,
Ohio.
WHEREFORE, your petitioner requests that your Honorable Court grant
permission for the sale of said real estate situate on Highland Avenue in
Washington, Washington County, Pennsylvania.

for the real estate and under all the circumstances, a better price than
could be obtained at public sale.

price and consideration set forth in said peti tionj one-half of said fund to be
turned over to said guardian for future administration, after guardian has
posted bond in accordance with court order in J ef.ferson Coun~ Ohio.
