MARINO, PRESIDENT JUDGE OF SAID COURT: The Petition of Emma E. Clark, .respectfully represents: 1. That Robert R. Clark, late of Borough of Claysville, Washington County, Penna., died intestate on January 8, 1967, and Letters of Administration on his estate were granted to your Peti1lioner on March 9, 1967, and Surety Bond filed in the amount of $.=,ooo.oo. 2. That Robert R. Clark died seized of, inter alia, the follcwing described real estate, to wit: ALL that certain parcel of ground situate in the 3eventh Ward of the City of Washington, Washington County, Penna., and lmown and designated as a part of Lot No. 22, Section "A", in the plan of lots laid out by John F. Hess et al., and known as the ''Hess Lots". BEGINNING at a stake on the Northern line of Tube Alley· and on the Southwestern corner of Lot No. 23, Section "A" in said plan; thence in a Westerly direction, along the Northern Line ~f Tube Alley, for a distance of 50 feet, to its intersectio with ~cAdam Avenue; thence along the Eastern property line of r1cAdam Avenue, in a Northerly direction, for a distance of 27.,44 =eet to a cross on the concrete; thence through Lot No. 22 on the :~ine parallel to Allison Avenue, in an Easterly direction, for a distance of 50 feet to a stake; thence along the dividing line between Lots Nos. 22 and 23 in said plan, in a Southerly directio 'for a distance of 27.44 feet;;to the Place of Beginning. Upon 1ofhich is erected a one ·story frame building. UNDER ANP SUBJECT to such exceptions, reservation <::ondi t ions and covenants a.§: are contained in the chain of title. That deceased left personalty appraised at $4,B64.83, ~her real estate than the subject matter of this Petition app- ["aisec. at $10,000.,00, subject to a m~~tgage of over $11,000.00, "Yhich is being foreclosed, and the subject real estate appraised .. , at $550.00. A copy of the Inventory in.this estate is attached here'to and marked Exhibit "A". 4. That the estate of deceased is clearly insolvent. 5. That on December 20th, 1967, Carl M. Kotwica agreed in wtiting to purchase subject real estate for $750.00, and your Petitioner agreed to sell same, subject to approval of your Honorable Court. One Hundred ($100.00) dollars, has been paid down by the buyers. See photo of agreement attached hereto and marked Exhibit "B". 6. That attached hereto and made a part hereof is the Afficavi t of two z:esponsib"ie. persons familiar wit}l the value of .real estate in the vicinity of the ~eal estate proposed to be sol , givir.g. the fair value of the rea.l estate herein described. 7.' That your Petitioner has received no higher offers for said real estate, .has previously sold said real estate three t~mes and then had the buyers reneg. Said real estate is assessed at $360.00, for 1967 tax purposes. 8. That your Petitioner desires to complete the proposed sale and de.liver a proper deed to the purchaser named in the Sales. Agreement. WHEREFORE, your Petitioner prays your Honorable Court to ~ake an Order relative to Additional Bond in this matter (your '?etitioner being already under Surety Bond in the amount of -~5~000.00, in accordance with the Act of As~embly in such case made and provided. · STATE OF PENNSYLVANIA .)
