OF THE INCOMPETENT ESTATES ACT
OF 1955 AS AMENDED
TO THE HONORABLE P.VINCENT MARINO,PRESIDENT JUDGE OF SAID COURT
The petition of Madeline Conner respectfully
represents:
1.The petitioner isa r~sident of South Strabane
Township,Washington County,Pennsylvania,and the daughter of
Jacob S.Rodgers,also known as Jacob S.Rogers.
2.Jacob S.Rodgers is eighty-three years of age.
He is a widower and lives alone at R.D.fl2,Washington,South
Strabane Township,Washington County,Pennsylvania.His next
of kin are your petitioner and Frances Holzapfel.
3.Recently Jacob S.Rodgers was confined to the
Washington Hospital because of inability to care for his own
needs.
4.The condition of Jacob S.Rodgers is such that
because of mental infirmities of old age he is unable to
manage his property and is liable to dissipate it or become the

5.That the estate of the said Jacob S.Rodgers so
far as petitioner knows,is as follows:
a.House and two acres,'South Strabane Township,
(life estate only).

b.Bank account with Pittsbu~gh National Bank,
checking account,$5,000 plus.
c.Bank account with Pittsburgh National Bank,
checking account,$6,000 plus.
d.Various stocks (no idea of exact value)'.
6.That the names and addresses of the next of kin
are as follows:
a.Madeline Conner

Washington,Pennsylvania
b.Frances Holzapfel
R.'D.2'
Monongahela,Pennsylvania
7.That the proposed guardian is Madeline Conner.
8.That no other court has ever assumed jurisdiction
in any proceeding to ,determine the competency of the said Jacob
s.Rodgers and he has no guardian of his estate or person.
WHEREFORE,your petitioner prays that a citation
issue directed to the alleged incompetent,with notice thereof
to the next of kin,to show cause why he should not be adjudged
an i~competent and a guardian of his estate and person be
appointed.

MR.DERRICO:T4.~$is the time set for hearing on Petition
for Appointment of Guardian for Jacob S•.Rodgers~and it was
filed at Number 81 of 1968~O.C.Ahd at thIs time,we want to
a busy schedule and we promised him he could get out of-here
appearance for them.So at this time,if the Court would please,
of course~they are here and we represent them.We filed our
Holzapfel are both here in Court and are ready to testify;and that
fairly early.
we'd like to have Dr.Perry Smith take the stand because he's got

DIRECT EXAMINATION BY MR.DERRICO:
Dr.Smith,will you tell us what your occupation is and where your
office is?
Iam.a physician,M.D.,and my office is in the Trust Building her~
in Washington.
Are you a regular practicing physician licensed under the State of
Pennsylvania?
lam.
And how long have you been a physician?
Since 1955;.'licensed to practice in Pennsylvania.
In your practice,have you had occasion to come in contact with
Jacob S.Rodgers,the party involved herein?
Yes,I have.
Will you tell us generally what you have done medically for Mr.j
Rodgers?
I have seen Mr.Rodgers on several occasions..The most recent
being the past---I'm not quite sure if it was for the six months---
he was hospitalized one time,which was a hernia,which was re:'i
paired.He showed signs of mental deterioration,was deli-ri:Ql1s:"
shall we say for a period of time.At that time,he recovered
to some extent and was discharged from the hospital.Then later
we had occasion to re-hospitalize him because of mental deteriora
t ion,at which time he s petlt.most6L.hisc:.hospitalization period

on the Psychiatric Ward at the Washington Hos pital.During this
time,he was largely confused and disoriented,expressed numerous
ideas,which did not agree with reality about things that were happening
to him and people were doing things to him,and was just generally
overall confused and disoriented for the greatest part of the time.
And there would be periods when he would seem fairly lucid,but
overall,his mental status was such that he was not,as we say,in
.touch with reality at the best part of the time.
Doctor,in your medical opinion,do you think Mr.Rodgers will

man came to my door at my house and asked me if I knew where

township police had met him up at East Washington intersection of
70 and brought him down to show him where my father livedI and
he said I "We've been looking for him everywhere and we can't
find him."And I saidl well---I kept the door lockedl I talked

saidl "h'e;was a hearing aid representative and that he must
definitely talk to my father and see him because he had business
with him and I saidl "Nol my father has already spent $600.00

with the checking;since the last time he seemed worse since he
was in the hospital the last time,about paying anything.He won't

It happened at the Washington Hospital several times when the nurSE s
would go---he was restrained and when they would go to unloose
him,he wanted to pay each one of them to take off the restraints
to put him to bed.
In other words,he wanted to pay the nurses $25.00 for just helping
him get dressed.

And does your father have any idea of the amounts of monies or
properties he still has left in the estate?
I doubt very much if he does,except that he realizes that he has
some money in the Pittsburgh Bank,and he has some in the Mellon
Bank.On checking accounts,he doesn't realize.He keeps all
of his statements.And now in the last few weeks,several times
he's gone through these statements and he doesn't know which one
is 1955 or '65 or '67.

and he'll say,"This is how much money I have in the Pittsburgh
Bank."Maybe the next time he'll bring me one that's the Mellon

Q Does your father have tendency to need help at home?Does he live
alone?
A I've been with him constantly since his op,'eration in October while
he's been home.
Q In other words,he needs constant supervision?
A Yes.
Q Does he have a tendency to wander away from home if you are not
there?
A Yes.
Q What does he do?
A On two different occasions,before he was hospitalized the second
time,I had been with him constantly and I thought perhaps if I
would get out of his sight,not annoy him,he might settle down and
be better.But I got in my car and watched him,unbenounced
to him,and he walked away.Oh,I know that he must have walked
15 miles.He walked in the rain for three hours and my husband
and I finally found him.He had gone through a field and we lost
track of him and the neighbors had told us where they saw him.

about 5:00 o'clock,he left the house and,walked in the dark and
I passed him on the road twice to see where he was going,and he
went to the service station and got a cup of coffee and came back
to the house.Then he told the neighbor woman the incision had
opened and they had to call the ambulance:And she called me
and my daughter got in contact with me and I was still in the car
watching him,so I called the ambulance and had him brought back
to the hospital.
Was his incision bothering him?
No.His incision was held up like the other side was or:e~afed.
on 14 years ago.There was nothing wrong with him.
In your opinion,Mrs.Connor,if you weren't there to help him
and keep supervision on him,would he possibly get hurt?
I think he would.I know he would,because just that---those two
days during the times that"I wasn't in the h.ouse,he had fired up
the furnace so hot that it burned all the paint off the furnace,and
the wood at one of the registers is burned brown.And I feel
certain that he would.Just last week,he took paper bags out in

the snow and set themaflre and came in and told me that he thought
he had burned up my sister's little dog.He burned it up;he's throu "h
with that dog.He just don't know what he's doing.

around the countryside?

FOR MAINTENANCE (AND APPROVAL OF PAST-ALLOWANCES)
AND NOW comes the Mellon National Bank and Trust Co.,
Guardian of the Estate of Jacob Rodgers,also known as Jacob
Rogers,an inco'mpetent,and petitions as follows:
1.The petitioner was appointed February 23,1968,
by your Honorable Court to be the Guardian of the Estate of the
said incompetent.
2.Since the time of your petitioner's appointment,
the incompetent has been kept and maintained by Madeline Connor,
one of the daughters of the incompetent,in a pome in which the
incompetent has a life estate.
3.Madeline Connor has been making every attempt to
maintain the incompetent in the same surroundings and in the same
manner to which he was accustomed,including taking the incom-
petent on rides to do his errands and to see his friends.
4.Your Petitioner has set a monthly allotment to
Mrs.Connor along with allowance for mileage traveled by her
with the incompetent.(See accounting attached.)

5.One other heir of Jacob Rodgers,another daughter,
Frances Holzapfel,at various times,has criticized payments to
Mrs.Connor for maintenance of Mr.Rodgers,the incompetent.
6.The ward is presently receiving the sum of $92.00
per month social"security check.
7.The petitioner estimates the annual expenses in the
future will be as follows:

WHEREAS on July 11,1969,a Petition entitled
"Petition for Permission to Pay Allowance for Mainten,ance (And
Approval of Past Allowances)"was filed by the Mellon National
Bank and Trust Company,Guat:dj'an o£-the-Es:tate:.of Jacob Rodgers,
and,
WHEREAS a hearing was scheduled for July 17,1969,and
then rescheduled for August 14,1969,and,
WHEREAS the said Petition was primarily being presente
in order to get an order to save criticism from one of the heirs
at law of the said Jacob Rodgers,and,
WHEREAS the said heir,Frances Holzapfel,has withdra
her objection to the monthly allotments to Mrs'.Madeline Conner
