PETITION FOR APPOINTMENT OF GUARDIAN ·UNDER SECTION 301 OF THE INCOMPETENT ESTATES ACT OF 1955 AS AMENDED TO THE HONORABLE P.VINCENT MARINO,PRESIDENT JUDGE OF SAID COURT The petition of Madeline Conner respectfully represents: 1.The petitioner isa r~sident of South Strabane Township,Washington County,Pennsylvania,and the daughter of Jacob S.Rodgers,also known as Jacob S.Rogers. 2.Jacob S.Rodgers is eighty-three years of age. He is a widower and lives alone at R.D.fl2,Washington,South Strabane Township,Washington County,Pennsylvania.His next of kin are your petitioner and Frances Holzapfel. 3.Recently Jacob S.Rodgers was confined to the Washington Hospital because of inability to care for his own needs. 4.The condition of Jacob S.Rodgers is such that because of mental infirmities of old age he is unable to manage his property and is liable to dissipate it or become the victim of designing persons.(~Ei(h'b;f'f1") 5.That the estate of the said Jacob S.Rodgers so far as petitioner knows,is as follows: a.House and two acres,'South Strabane Township, (life estate only). ·' b.Bank account with Pittsbu~gh National Bank, checking account,$5,000 plus. c.Bank account with Pittsburgh National Bank, checking account,$6,000 plus. d.Various stocks (no idea of exact value)'. 6.That the names and addresses of the next of kin are as follows: a.Madeline Conner R.D.2 Washington,Pennsylvania b.Frances Holzapfel R.'D.2' Monongahela,Pennsylvania 7.That the proposed guardian is Madeline Conner. 8.That no other court has ever assumed jurisdiction in any proceeding to ,determine the competency of the said Jacob s.Rodgers and he has no guardian of his estate or person. Iam.a physician,M.D.,and my office is in the Trust Building her~ in Washington. Are you a regular practicing physician licensed under the State of Pennsylvania? lam. And how long have you been a physician? Since 1955;.'licensed to practice in Pennsylvania. In your practice,have you had occasion to come in contact with Jacob S.Rodgers,the party involved herein? Yes,I have. Will you tell us generally what you have done medically for Mr.j Rodgers? I have seen Mr.Rodgers on several occasions..The most recent being the past---I'm not quite sure if it was for the six months--- he was hospitalized one time,which was a hernia,which was re:'i paired.He showed signs of mental deterioration,was deli-ri:Ql1s:" shall we say for a period of time.At that time,he recovered to some extent and was discharged from the hospital.Then later we had occasion to re-hospitalize him because of mental deteriora t ion,at which time he s petlt.most6L.hisc:.hospitalization period 4 on the Psychiatric Ward at the Washington Hos pital.During this time,he was largely confused and disoriented,expressed numerous ideas,which did not agree with reality about things that were happening to him and people were doing things to him,and was just generally overall confused and disoriented for the greatest part of the time. And there would be periods when he would seem fairly lucid,but overall,his mental status was such that he was not,as we say,in .touch with reality at the best part of the time. Doctor,in your medical opinion,do you think Mr.Rodgers will get better or will he get wors e ? No,with the sort of illness he has,which is chronic deterioration of the brain and mentality because of age and hardening of the arteries,this kind of condition will be expected to deteriorate with time and not to improve. In your medical opinion,do you feel that because of the mental infirmities of his old age,he is unable to manage his own affairs? Yes,very definitely. Do you feel that there are people or there could be people who coul ~ take advantage of him in his condition as it is now? A Yes,he could be very easily convinced to do things that would be detrimental to his overall well being. Q Do you feel that in the future he is going to need more medical attention? A Oh,yes. 5 ·e Q And he will need confining possibly? It happened at the Washington Hospital several times when the nurSE s would go---he was restrained and when they would go to unloose him,he wanted to pay each one of them to take off the restraints to put him to bed. In other words,he wanted to pay the nurses $25.00 for just helping him get dressed. That's right. And does your father have any idea of the amounts of monies or properties he still has left in the estate? I doubt very much if he does,except that he realizes that he has some money in the Pittsburgh Bank,and he has some in the Mellon Bank.On checking accounts,he doesn't realize.He keeps all of his statements.And now in the last few weeks,several times he's gone through these statements and he doesn't know which one is 1955 or '65 or '67. T.,~,~-, ,L ': A ,That's right.And one time he'll bring me out one,maybe it's 1965 and he'll say,"This is how much money I have in the Pittsburgh Bank."Maybe the next time he'll bring me one that's the Mellon Bank and say,"This 'is ho~much I have in the Mellon Bank.It might be one for '66. Q Does your father have tendency to need help at home?Does he live alone? A I've been with him constantly since his op,'eration in October while he's been home. Q In other words,he needs constant supervision? A Yes. Q Does he have a tendency to wander away from home if you are not there? A Yes. Q What does he do? He didn't know I was watching him and the.next morning I still was watching him all the time constantly.And the next morning about 5:00 o'clock,he left the house and,walked in the dark and I passed him on the road twice to see where he was going,and he went to the service station and got a cup of coffee and came back to the house.Then he told the neighbor woman the incision had opened and they had to call the ambulance:And she called me and my daughter got in contact with me and I was still in the car watching him,so I called the ambulance and had him brought back to the hospital. Was his incision bothering him? No.His incision was held up like the other side was or:e~afed. on 14 years ago.There was nothing wrong with him. In your opinion,Mrs.Connor,if you weren't there to help him and keep supervision on him,would he possibly get hurt? I think he would.I know he would,because just that---those two days during the times that"I wasn't in the h.ouse,he had fired up the furnace so hot that it burned all the paint off the furnace,and the wood at one of the registers is burned brown.And I feel certain that he would.Just last week,he took paper bags out in 14 15 the snow and set themaflre and came in and told me that he thought he had burned up my sister's little dog.He burned it up;he's throu "h with that dog.He just don't know what he's doing. .e Q Does he have any concept of where he's at when he's wandering around the countryside? ~A No,I don't think,because I took him for a ..r.ide yesterday,and z<~)0 when I turned on to the proper road,he got real excited and I III ZZ~thought he was going to jump out of the car.He said,"You're ioI-~Z :r::III ;Q on the wrong road."So I don't think he does know.
