PETITION FOR FIXING BOND
The Petition of Ruth R.Blakeslee,Administratrix of the
Estate of Bobby Earl Blakeslee,deceased,respectfully represents:
1.That she is the administratrix of the Estate of Bobby
Earl Blakeslee,deceased,having been duly appointed by the
Register of Wills of Washington County,Pennsylvania,on April
10,1967.
2.The decedent died on October 17,1966,as a result of
injuries which he sustained on the same day when he was struck
by a truck owned by the defendant,Jerome Pompei and operated by
the other defendant,Jess B.Lindley,Jr.,near his home on
Route 136 in Somerset Township,Washington County,Pennsylvania.
3.The decedent was 12 years of age at the time of his death.
4.Your petitioner filed suit under the wrongful death and
survival statutes of the Commonwealth of Pennsylvania against
Jerome Pompei and Jess B.Lindley,Jr.on account of said injurie~
and death.
5.The on~y persons entitled to share in the proceeds of
both actions are the decedent's parents,Charles W.Blakeslee
and Ruth R.Blakeslee.
6.Your petitioner and her counsel,Richard DiSalle,have
negotiated a settlement of both actions for the total sum of
$6,880.00,which is to be apportioned as follows:The sum of
$6,000.00 towards the wrongful death action and the sum of $880.0
toward the survival action.
7.It will,therefore,be necessary to administer the afor -
said sum of $880.00 in the decedent's estate.
8.The decedent's estate consists of no real estate,and
the following personalty:The sum of $5,514.70 in cash (repre-
senting the balance in a trust account in the Pittsburgh Nationa
Bank)and the aforesaid sum of $880.00 representing the proceeds
of the settlement of the survival action.
9.The funeral bill,hospital bill,all medical bills and
other expenses of administration total the sum of $1256".48 and
all of said bills have beenpaid.
10.At the time of her appointment as administratrix,your
petitiQner filed a bond with corporate surety in the amount of
$6,000.00.
WHEREFORE,your petitioner respectfully requests that this

court enter an Order excusing her from the filing of an additiona
bond for purposes of settling the survival action aforesaid.
