WILL OF BLANCHE H.SHAW
I,BLANCHE H.SHAW,of Chartiers Township,Washington County,
Pennsylvania,do hereby make,publish and declare this my Last Will
and Testament,hereby revoking any other will or wills by me at any
time heretofore made.
FIRST.I direct my Executor hereinafter named to pay all
my just debts and funeral expenses as sQon as convenient after my
decease.
SECOND:I give,devise and bequeath all my estate,of·what-
soever kind and wheresoever situate,unto my beloved husband,Wilbert
Lawrence Shaw;provided,however,that if,my said husband shall have
predeceased me,or shall ~ail to survive me by a period of sixty days,
then and in such case I give,devise and bequeath my estate to my
four sons in the foll~wing proportions:Wilbert Thomas Shaw one-
fourth (1/4)thereof;Alvin Hunter Shaw three-eighths ·(3/8)thereof;
Homer Lawrence Shaw one-fourth (1/4)thereof;and Gaylord Grounds
Shaw one-eighth (1/8)thereof.The division which I have thus made
among my.four belovedo sons is-for the pu~poseof equalizing benefits
which they have rece:lved,in money,education,or property,from my
husband and me during our lifetime.
THIRD"AND LAST.I nominate,consti-tute and appoint my beloved
husband,Wiibert Lawrence Shaw,to be Executor of this my Last Will
and Testament;provided,however,that if my said husband shall have
predeceased me or ,shall for any reason be unable to serve,then and
in such case I nominate,constitute and appoint my son,Alvin Hunter
Shaw,to be Executor of this my Last Will and Testament.

.Your letter of April 30th to this office inquired as to the
taxability of the life estate in the above estate~
The situation we have here is a deed of conveyance from
parents to.son whereby the parents reserve a survivors life estate and
for which conveyance the son paid the parents $8,000.00,being one-
half·the value of the real estate at the time of conveyance.This
conveyance reserving a life estate is'clearly subject to tax under
S~ction 224 of The Inheritance Tax Act based on valuation as of the
date of death of the life tenant.
Inasmuch-,as the son previously paid $8,000.00 as one-half the
value as of the time of conveyance and the admitted value of the life
tenant •s remai ning one-half·interest in the life estate is $8,120.00,
this amount should be included in the appraisal of the estate of the
mother at.the 2%rate.This is to be without any credit for improve-
ments made by the,son,all of Which'inured to·the son's benefit.
