by reason whereof the power of granting administration thereof doth belong to me;I therefore,confiding
in your fidelity,do by these presents grant unto you these LETTERS OF ADMINISTRATION,here-
by committing unto you fullpower to administer the goods and chattels,rights and credits,which were
of said deceased within.this Commonwealth,you having taken and subscribed the oath of office pre-
scribed by law;requiring you to well and truly administer the goods and chattels,rights and credits,
which were of said deceased,and to exhibit a true and perfect inventory thereof into the Register's
office,at Washington,within ninety days,and to render a just and true account of your administration
at the expiration of six months from the date hereof,and to regard and comply with the provisions of
the laws relating to inheritance taxes.

Mr.Humbert had various undivided interests in
piece of real estate sold.That was the home at 666 East Maiden
the best way to do is to have that real estate reawarded to the Ad-
ministratrix for th;e purpose of trying to dispose of some of those.
And we anticipate
I am afraid there will be'trouble in the future.Otherwise,
outside of Washington coming from his father.

There will be an Income Tax Return to file for
1968 on account of the capital gain on the sale of the home on East
M;aiden Street.And I will prepare that Return and hand up the
amount involved to Your Honor.'I have ordered certificates of
liens on the sale of that property and will hand those up.I haven't
added the description of real estate because it seems to me if there
i~a reaward,it's a simple matter at this time of reawarding the
real estate as set out in the Inventory.And after talking with Mr.

~azza,the tax appraiser,yesterday,I suspect I may have to corre t
what I have.I'm not sure.Either he's wrong or I am wrong.

I found that the appraisement,tax appraisement had not been made
as of yesterday and that's the reason I talked to Mr.Mazza and I

ass'ume that will be handed up by the·tax people.The wife,of cours ,
her tax is at two percent.The other heirs are collateralsand
the'tax is 15 percent.And there maybe some difficulty in figuring
out how to pay those various taxes.I'd suggest,if Your Honor has
an ,open date,the week of April 7 for,the hearing.

There is some small undivided interest in land which will have to

MR.ANDERSON:That's on real estate.No.And I don't know what 0
say about that.He's the undivided interest.Originally I had som
idea of calling a sale,but that fell through.But the other is an

'sh~re'ceived a fee of $1400.00 which is not an inconsiderable fee
for,the amount of work which we know as lawyers and Judges,the
fiduciary does;routinely,it is the attorney who does the work and
the $1400.00 is a gratuity or what is paid for theoretically assuming
the:..rie~·ponsibility ..Now th.e Court will recall tJ;1is case,I think.
We had,I believe,good reasop to contest her righ,t to take.There
w,as no legal or formal marriage.The allegation was of a common
law marriage.And what we had to go on,if the Court will recall,
.was a .very substantial series of deeds which had been executed by
th~s decede~t as a single man.He had conducted almost all of his
legal business through John McCreight of this Bar,and John McCre'~ht
obviously was of the impression"that this man was a s.ingle man or
he would not have drawn the deeds and permitted them to be execute(
as a single man.

Now it appeared that what happened was that this
man was leading sort of a double life;I thinkt there is a movie
called Captain's somethingwhere he had one wife in one port and
one in another and they never met.What happened was he apparentl~

out to the public certainly in.Washington that he was unmarried.

PETITION TO WAIVE OR FIX ADDITIONAL BOND.
To the Honorable P.V.Marino,President Judge of said Division:
The petition of Merle M.Humbert,administratrix
of the estate of Joseph A.Humbert,deceased,decedent above
named,respectfully represents,to wit:
1.The above named Joseph A.Humbert died intestate,
on October 23,1966,domiciled at the City of Washington,Wash-
ington County,Pennsylvania,and your petitioner,Merle M.Humbert,
his widow,was thereafter duly appointed administratrix of his
estate by the Register of Wills of Washington County,Pennsylvania,
and duly qualified and is now acting as such.
2.Petitioner filed her first and partial account
as administratrix at No.106 of 1969,A.A.,embracing personal
property and the proceeds of sale of one piece of real estate
of which decedent was sole owner,situate in the Fifth Ward,City
of Washington,Washington County,Pennsylvania;and your Honorable
Court by decree dated May 29,1969,filed to said number,confirmed
said account,directed distribution of the fund before it,and
re-awarded to petitioner as administratrix for further accounting
the sum of $500.00,together with certain other items of real
estate in which decedent owned undivided interests,ch~f1y one-
third interests as one of the heirs of his father,P.P.Humbert
(and grantee of his father's second wife),inclduing the one-
third interest in such land,hereinafter described,which is the
subject of this petition.

3.Petitioner desires to join with the owners of the
other undivided interests in selling at private sale,to
Washington Northgate Limited Partnership,of Washington,
Pennsylvania,assignee of Willard H.Bryant,for the sum of
$50,000.00,a certain tract of land situate partly in the
Seventh Ward of the City of Washington and partly in South
Strabane Township,Washingto.n County,Pennsylvania,consisting
of two adjoining pieces,contai.ning approximately 12 acres,
in which said decedent owned an undivided one-third interest,
being the land set out as item 4 A in the inventory and
appraisement of decedent's estate heretofore filed and being
unimproved,and has executed and delivered a written article
of agreement providing for such sale in which said land so to
be sold is more fully described,copy thereof being attached
hereto and made part hereof.
4.Decedent's heirs,besides your petitioner,are
the other parties involved as grantors in such sale,being
owners of the remaining undivided interests i.n said land,and
by their attorney have acknowledged receipt of notice that
this petition will be presented'to your Honorable Court,
forthwith,acceptance of notice and consent being attached.
5.Other real estate of said decedent remaining
unsold includes parts of lots 1 to 9 inclusive,Humbert
Addition No.2 in said City of Washington and parts of lots
10 and 11 in said Addition and said South Strabane Township,
fronting on Tyler Avenue;and parts or all of lots 24,130,40
to 43 inclusive,and 35 to 38 inclusive,in said Township,
in which said decedent owned a one-third interest,and an
undivided one-half interest in lot 64,Humbert Addition
No.1,in said Township.

6.On or about March 18,1970,Stanley C.Buick
et ux.,claiming to be equitable m·mers of said described land
by reason of an article of agreement executed by said decedent
for himself and the other owners thereof in decedent's lifetime
on April 8,1966,filed suit for specific performance in the
Court of Common Pleas of Washington County,Pennsylvania,at
No.6415 in Equity,which proceeding is pending but is to be
settled for a substantial sum,to which petition has agreed to
contribute the sum of ~~66.67.Other than this,and unpaid real
estate taxes,there are no liens or charges affecting said
decedent's interest in said property.
7.At ,the time of petitioner's appointment as
administratrix,she gave bond in the sum of $1,000.00 as such
administratrix,which is still in effect and is believed
sufficient to cover the re-award of $500.00 mentioned 1..0
paragraph 2 hereof.Subsequently,upon sale of decedent's
real estate situate in the Fifth Ward of said City of
Washington,mentioned in said paragraph 2,petitioner was
directed by your Honorable Court to give,and she did in fact
give,additional bond in the sum of $20,000.00 to cover the
proceeds of such sale;however,the proceeds of such sale were
distributed by said decree of distribution of May 29,1969,
having been accounted for in petitioner's first and partial
account as aforesaid,and petitioner's and surety's liability
on said additional bond has been considered terminated,although
there has been no formal discharge of liability.
8.Affidavits of two qualified persons to the
effect the proposed sale price of $50,000.00 and of one-third
thereof or $16,666.67 for said decedent's univided interest
in said real property to be sold is the fair market value
thereof are attached hereto.

Wherefore,showing as above,petitioner respect-
fully prays that your Honorable Court approve said private
sale,and waive or fix the amount of additional bond to be
give.n by your petitioner in connection with said sale,pur-
suant to sec.541 of the Fiduciaries Act of 1947.And she
