AND PERMIT EXECUTRIX TO PROCEED IN THE ADMINISTRATION
OF DECEDENT'S ESTATE
The Petition of Virginia Miller, by her attorney, OLIVER N.

l. Virginia Miller, of 212 Carland Drive, Carlisle,
Pennsy~vania,,. .. Jcumberland Courity), qualified as the Executrix of
the Estate of Eliza.beth Booker, deceased, and letters· testamen-
tary ~vere .issued to her by the Register of Wills offv"ashington
County, on Feb~uary 3, 1969.
2. Elizabeth Booker, formerly of 119 Thitd Street, Califor-
l !./

::ua, Washington County,. Pennsylvania, was an adjudged incompetent,
. ~t No. 46 of 1967, o.c., and died testate on December 24, 1968,
-.vhile a patient at Torrance .State Hospital. Her will was dated
April 21, 1960, and was probated on February 3, 1969. Attached
hereto, made a part hereof, and marked Exhibit "A" is a photo-
static copy of her Last Will and Testament.
3. At No. 434 of 1967, O.C., your Honorable Court appointed
~ guardian for the Estate of Thomas Cecil Hooke~, as a result of a
hearing held on December 28, .1967, by Decree dated January 3,
1968. On·May l, 1968, your Honorable Court conducted a hearing

on a P~tition for instructions by the g~ardian of the Estate of
Thomas Cecil Booker, then adjudicated .ar: inco:spet'ent in order to
deter~ine title or ownership to certain bank accounts and other
it~ms in the Estate of Thomas C~cil Booker and to determine

wh~ther they w·ere the p·roperty of Thomas. Cecil Booker, pr
ElizAbeth Booker, or both.
4. At No. 671 of 1967, your Honorable Court permitted Fred
Ki~lius to intervene in the hearing at N;). 434 of 1967, recited
a:fcresaid.

5. On O~tober 22, 1970, your Honora~le Court handed/an
adjudication wherein the title to the as5ets herein above men-
tioned was det~rmined and no party to th~ Estate has taken
exception to said adjudi~ation.
6. On December 1, 1969, at No. 93 o: 1969, and No. 46 of
l9E7, your.Petitioner'present~d a petiticn to your Honorable .
Court to transfer funds into the Estate e~f a deceased incompe-
tent. Purs.uant to said Court Order, the funds in the possession
of Western Pennsylvania National Bank, gLardian of the Estate of
Elizabeth Booker, were transferred to Virginia Miller in the
amount of $55,856. 96 and the said Virgir:ia Miller was directed 1
to invest said amount in legal investments but that she was to
mak~ no expenditures from said funds without.authorization from
the Court.
7. The adjudication as trr the a~sets having been made by
your Honorable Court as aforesaid on Oct;)ber 22, 1970; and
title. to the assets having been adjudicated, your Petitioner
now desires to pay over to the guardian o: ~he.Estate of Thomas
Cecil Booker those assets to which said guardian is.entitled by
virtue of said adjudication, and further desires to proceed with

the administration of the Est~te bj the filing of the necessa~y
inventories, payment of. bills, filing of accounts, .and Petition
for Audit 1n the Estate of Elizabeth Booker.
8. At No.93 of 1969, the Wester~ Pen~sylvariia National Bank
guardian of the Estate of Elizabeth Booker, filed an account
andl pres en ted .a P.eti ti.or.i for .Audit of the same indi.ca ting the
aforesaid balance in the .::.amount of $55; 856.96. Attached hereto
madle a part hereof, and marked Exhibit "Bn. is a photostatic
copy of the petition for audit referred to •.
. -·~--. 9. Urtder the terms of the Order and D~cree of your Htinorabl
Court of December l, 1969, your Petitioner has no power to pay
to the guardian of Thomas Cecil Booker t•e funds due him, pur-
suant to the adjudication of ycur Honorable Court on October 22,
1970, nor does your Petitioner have power to proceed with the
adrrinistration of the Estate of Elizabeth Booker, deceased,
to a final conclusion.
WHEREFORE, your Petitioner respectfully prays your Honorable
Court to make an Order and Decree permit~ing your petition~r to
pay t~ the Pittsbu~gh National Bank those assets ih your Peti-·
ticners possession which belong to Thomas Cecil Booker, an in-
corrpetent, pursuant to the adjudication G)f your Honorable Court,

and that your petitioner be released fron the restriction that
she shall make no expenditures from the ~unds of Elizabeth
Bocl<er, deceased .

Vi::-ginia Miller, Executrix, shall pay over to the Pittsburgh National Bank
all funcs in h3r possession due to the Estate of Thomas Cecil Booker, an in-
competent, p·1rsuant to the adjudication of this Court, dated October 22, 1970,
and
Pi-:tsburgh National Bank is authorized to pay over to the Estate of Thomas
Cecil Booker, Jr., the balances in Checking ACcount No. 3-256714, Savings
Accour:t No. 9932 and Savings Account No.· 9933 of record in their California
Office, and
Virginia Miller, shall proceed in the administration of the Estate of .
