ESTABLISH DEATH OF ABSENTEE
TO THE HONORABLE P.V.MARINO,PRESENT JUDGE OF ORPHANS COURT:
The Petition of Mrs.Grace Devey respectfully represents:
1.'l'hat your Petitioner is the sister of Ralph 'H.Hultz
and she resides at R.D.#1,Venetia,Washington County,Pa.
2.That said Ralph R.Hultz,a presumeddecedent,was ",
domiciled at R.D.#3,Claysville,Washington County,Pa.,
and was bor~January,7,1911.
3.That ~he said Ralph R.Hultz left his domicile in
the summer of 1952,and has been absent and unheard of since
that time except as set forth hereafter,and,so your
Petitioner believes him to be deceased.
4.Although at the time said Ralph R.Hultz left his
domicile,he informed Petitioner that he was going to leave,
he did not inform her where he was going.
5.That your Petitioner learned later that her brother,
Ralph R.Hultz,had lived at 1101 Lee Street,Charleston,
West Virginia,and your Petitioner was informed by the landlad
there that he had lived there since March 7,1953 and had left
there October la,1953.
b.That the said Ralph R.Hultz was unmarried,having
been divorced,and did not have any children.That his only
/heirs and next of kin are your Petitioner,and David Hultz,
5038 Ozark Driv~;Pittsburgh,Pa.,and Joseph Hultz,1667
Skyline Drive,Pittsburgh,'Pa,his nephews ,who were sons of
Howard Hultz,brother of said Ralph R.Hultz,who died
July 4,1953,a resident of Allegheny County,Pa.
7.That the Estate of said Ralph R.Hultz consists of
a savings account in the Union National Bank of Pittsburgh at
its Bridgeville Office having a bale.nce as of January,1965 of
$279.68 and 33 shares of stock of the Union National Bank
of Pittsburgh,which stock has been threatened to be escheated
to the state of Pennsylvania after September 1,1966.
8.That the said Ralph R.Hultz to the best of the knowled e,
information and belief of your petitioner left no will,and your
petitioner is therefore entitled to Letters of Administration
on his estate,should he be ~eceased.
WHEREFORE,Petitioner prays your Honorable Court under the
provisions of the Fiduciaries Act of 1949,as amended,to
decree the presumption of the death of said Ralph R.Hultz,and
to authorize the Register of Wills of Washington County to
grant Letters of Administration on his estate to your Petitioner.

of March 2,1961 concerning the above di~aharg~d veteran.
I am again enclosing a photocopy of his Army Separation..,.'.~Record showing his discharge on February 12,JP46.,
Since my letter,his sister,Mrs.Devey,has
started a Presumption of Death Proceeding in the Washington
County,Pennsylvania Courts 'to have him declared legally
dead.Neither she,nor any of the members of the family
have heard of or heard from him since 1952.I since have
learned that the divorce referred to on the second page of
the enclosed letter was obtained on June 14,1940,in
Independence County,Arkansas.This,then,was before he'
entered service.'
At the request of Qur Judge here,I am again
asking your offices to recheck your records to see if you
have any record on him.I am also enc,~osing a photocopy of
an answer dated March 13,1961,received from the Correspondence
Group,Index Section.If your office still finds no record
for him,please advise if,I should write to the War Department
or the Army Department and where,to determine if they can
locate his records,or him.In short,the Court here believes
that if he were deceased,either your office or the Army
should have a record of his 4eath.

of September 20,1973,addressed to the National Personnel
Records Center,St.Louis,Missouri,concerning the above
discharged war veteran.I am,also enclosing a photocopy of
papers I sent to the National Personnel Records Center
which consist of correspondence between myself and the
Veteran's Administration Office in Washington,D.C.,in
1961 and September,1973.I received all this correspondence
back from the National Personnel Records Center along with a .
form letter dated September 25,1973,to the effect that
because of a major fire at the Center on July 12,1973,
they are unable to take action on my inquiry.Also,they
sent a form letter called"Possible Sources for Verification
of Military Service".

As set forth in my letter of September 11,1973,to
the Veteran's Administration Central Office of Washington,
D.C.,there is Presumption of Death proceeding in the
Washington County Courts in which some testimony has been
taken.The record has been left open because the Judge
asked me to check with the Veteran's Administration again
and also the Army Department.Of course,if it can be
determined that Mr.Hultz is still living this would end
the Presumption of Death proceeding.On the other hand,
the Judge felt that if there were a record of his death,this
would also do away with a necessity of proceeding with the
Presumption of Death proceedings.Otherwise,we will have
to complete the same.I would appreciate it very much if
you could assist in this matter and any correspondence from
you will be made a part of the record in Court.

account for and respectively refund the amounts received from

sumption of Death Proceeding before the Orphans Court of Washingto
County,was presumed dead as of August 19,1975 by Court Order
dated August 19,1975 at 180 of 1966 O.C.,·and the Register of
Wills was authorized to grant letters of administration on this es
tate to Grace Devey,your instant Petitioner.
3.That the said RalphR.Hultz was unmarried,having
been divorced on June 4,1940 in the Chancery Court of Independenc
County,Arkansas,being case number 374 as appears by proof filed
in said presumption of death proceedings,and did not have any
children.The only heirs or next of kin are your Petitioner,his
sister,and David Hultz,5038 Ozark Drive,Monroeville,Allegheny
County,Pennsylvania,and Howard Joseph Hultz,3253 Bradberry
Drive,Aliquippa,Beaver County,Pennsylvania,his nephews,who
were sons of Howard Hultz,brother of said Ralph R.Hultz,who die
