Drummond,I direct that the balance remaining of said principal,and any accumulated income,shall be distributed to my wife,Thora Mar- guerite G.Drummond.If,however,my s aid wife shall not be living at the time of the decease of my said daughter,Patricia E.Drummond, I direct that the saia trust fund,or any balance remaining thereof, shall b~distributed as follows:One-fourth (1(4)part thereof to my sister,Clara Florence Myers,if living;if the said Clara Flor- ence Myers is deceased,then,I direct that such one-fourth (1(4) part shall bedtstributed to her children,share and share alike: One-fourth (1/4)part thereof to the First -2- Presbyterian Church of Monongahela,Old School,Monongahela,Pennsyl- vania;One-fourth (1/4)part thereof to the Polk State Hospital;and the remaining one-fourth (1/4)part thereof to the Shriners'Hospital for Crippled Chilcren,aColorado Corporation,Philadelphia Unit,Phil- adelphia,Pennsylvania. 4.I direct that my Executrix and Trustee,as the case may be,in addition to and not in limitation of any authority given to them by law shall have the following powers: A.For the payment of debts or for any purpose of adm- inistration,Or distribution,power to sell,mortgage,lease,alter, improve,partition and exchange all or any of my real estate,at any time during the continuance in whole or in part of the trusts under this my Will and at the termination thereof for purposes of distribu- tion selling at pUblic or private sale,for such prices and upon such terms as to cash and credit as they may deem best,or upon the reser- vation of ground rents,and the said ground rents in turn to extinguish or assign,and to grant and convey good and sufficient titles,without liability on the part of the purchasers or other persons S(I dealing ,. with the Executrix or Trustee,to see to the application of the pur- chase or consideration moneys.This power shall not be constnued to work a conversion of the real estate unless and until the power is actually exercised,nor shall this power be construed to extend the lien of debts. B.To purchase or otherwise acquire real estate and to exercise the same powers thereover as hereinbefore~provided with respect to the other real estate of the estate. C.To retain all stocks,bonds and investments owned by me,and to invest and reinvest in other stocks,bonds and invest- ments,without being confined to what are known as "legal investments," and to sell and transfer the same,either in -3- person or by attorney,without liability on the part of the purchaser to see to the application of the purchase or consideration moneys. D.To borrow money and pledge any stocks,bonds,or other personal property of the estate as security therefor,without liability on the part of the lender to see to the application of said money. F.To exercise any option to subscribe for stock., bonds or other investments. MR.LONG:Your Honor,I saw Patricia Drummond on March 26 at Robinson Developmental Center.Ms.Dr~ond was slightly verbal, but most ofher answers were not to the point and there was a certain amount of rambling and non-relating conversation in response to my questions.She was sitting on the floor and would not,get up at the time I was meeting with her and in my opinion she is not able to handle her own affairs and I would recommend that a guardian be appointed for her . THE COURT:It is so ordered.The guardian in making an accounting for the real and personal estate shall include an accounting of the assets included and distributed in accordance with this Court's schedule of distribution dated November 20,1974,at 63-74-71 by my predecessor Judge Paul A.
