AND NOW this tJ -day of August 1964 comes the Petitioner,
Anna Kubenik,through her attorneys,PEACOCK,KELLER &YOHE,and
makes claim for the family exemption allowance under the Fiduciaries Act
of 1949 and alleges as follows:
1.The Petitioner is Anna Kubenik whose address is School Street
(North Strabane Township),Canonsburg,Pennsylvania.
2.Joseph Kubenik,her father died intestate on the 11 thday of
May,1953,a citizen of Washington County,Pennsylvania,and living on
School Street,Canonsburg,Pennsylvania.
3.Letters of Administration were issued to Mary Baloga of
Burgettstown,Pennsylvania,on the 18th day of ~--=-M:.::.::;:a,,-y ,1964'.
4.The decedent was not survived by any spouse.
5.The decedent was survived by the following children but only the
Petitioner formed a part of his family household at the time of his death
and all of whom are adults:Anna Kubenik,Canonsburg,Pennsylvania;
Mary Baloga,Burgettstown,Pennsylvania;Frank Kubenik,Akron,Ohio;
a daughter in India;one child in the State of California;another child in the
State of California;one son unheard of since 1924 believed shot.
6.The family exemption is claimed by Anna Kubenik,the Petitione ,
who was the only person living with her father at the time of his death.
7.The family exemption in an amount specified by the Court is
claimed in cash from the funds in the hands of the Administrator.
8.The allowance of the claim prior to the Audit of the Account
is requested since the Petitioner must vacate the house in which she is
living since it has been condemned for highway purposes and a Writ of
Possession has been issued by the Court.
WHEREFORE the Petitioner requests the Court pursuant to Section
211 of the Fiduciaries Act of 1949 as amended to allow the claim of Anna
Kubenik to the family exemption in the Estate of Joseph Kubenik,deceased
and to award her payment of the exemption in cash.

ordered and decreed that Josephine Baloga shall collect the
proceeds of Mellon Bank checking account No.170-1773,pay the
legal expense,filing costs and divide the balance equally among
the following heirs at law of the decedent.

To The Honorable,The Judge of the Said Court:
The Petition of Josephine Baloga respectfully states that;
1.Joseph Kubenik died May 11,1953 a resident of Washington
County,Pennsylvania.
2.Mary Baloga of Burgettstown,PA was appointed Administratrix
of said estate o~May 18,1964 at BB60,page 167.
3.Said Mary Baloga had fulfilled her duties by filing an
Inventory on July 29,1965,an accounting on July 29,1965
.and filed an Inheritance Tax at TD 36,page 355 and an
account on July 29,1965.
4.Since that time said Mary Baloga,the Administratrix,died
May 1,1977 and Attorney George Modrak the attorney for the
Estate has died on January 20,1994.
5.The said estate appears to have been.completed,however an
estate bank account still is outstanding at Mellon Bank,
t.r-<.....:
Canonsburg,PA.Said Amount is·about $1,493.59.
6.No claims have been filed at Mr.Modrak's office since his
death.
7.Nothing further had been done in the last 10 years.
8.The only heirs of law of the decedent left that can be
ascertained are:

WHEREFORE petitioner requests that this Court,pursuant to
20 PA Consolidated Statutes §3102 authorize·her to receive and
collect the said Mellon Account No.170-1773 and distribute the
proceeds (after legaL expenses and filing costs)equally to the
five intestate heirs listed in paragraph 8 above.

SUBJECT:Estate of JOSEPH KUBENIK
1.This estate was brought to audit on September 17,1986.Decedent died
May 11,1953.
2.As the attached correspondence indicates,I have been unsuccessful in
prompting Mr.Modrak to complete this estate as were Mr.Vlachos and Mr.
Hana before me.
3.I am informed by Mr.Modrak that the administratrix has died and the
office remains vacant.
4.The best that I can piece this estate together is as follows:
A.Joseph Kubenik dies in 1953,intestate;
B.Prior to his death only Anna Kubenick remained in the home,an
estate was not raised and Anna treated the house as hers;
C.Condemnation proceedings are brought against the property and now
an estate has to be raised to receive the proceeds of the condemnation pro-
ceedings,$6,600.00;
D.An attempt was made to get the other five children to assign their
interest to Anna,two were obtained;
E.The net estate I would calculate at roughly $3525.66;
F.The Petition Sur Audit indicates an advancement to Anna Kubenick of
$3257.34 and Mr.Modrak's letter of January 29,1987,states she "was able
to get a small home by reason of the assignments of her brothers and sisters
is still mentally retarded ...II.,
G.It appears distribution of the entire estate was made to Anna Kubenik
even though the consent of three siblings was not obtained;

5.I believe further efforts to resolve this estate will not be productive.
While approximately $1750.may not have gone to the appropriate heirs,waiting
34 years after death and 22 years after audit,would appear to taint any claims.
6.Rather than citing Mr.Modrak,I suggest either this estate be striken
from the audit list or remain on the list but be administratively closed.

necessary papers.This estate has peculiar circumstances.
On or before 1930 all the children of the decedent left
home except one,the daughter Anna Kubenik.All the while
she was under the impression that it was her property.
Her father died in 1953.She paid off the mortgage.She
had been working at that time,and she paid the funeral bil s.

And she didn't know otherwise until the state condemned the
property two years ago then she found out she wasn't the
owner.Of course,her sister,Mary Baloga was appointed
the Administratrix.We have assignments from all the
brothers and sisters except one.There are two on the way.

Dear Mr.Modrak:
In response to my letter of April 25,1986,on May 2,1986,you brought in
a copy of a document purportedly signed on November 30,1964,by Anna Kubenik
which assigns her interest in the above-captioned estate to George Curtis',Jr.
"to the extent of $2500.00 representing the balance due under Articles of
Agreement."I do not understand.I thought all the brothers and sisters
were assigning their interests to Anna Kubenik?At least that is what the
November 6,1964,assignments executed by Mary Baloga and Frank Kubenik
purport to do.
I assume without knowing for certain that Judge Rodgers will accept the
,handwritten,undated,letter of Helen Lasefka as a renunication of interest,
however,I do not believe it can constitute the execution of the unsigned
attached carbon copy of an assignment to Anna Kubenik.
I suggest that you are not going to receive any new assignments and you
should proceed accordingly to close out this estate.Please deal with the
issues raised in my letter of April 25,1986.
