LAST WILL AND TESTAMENT
I,CATHERINE H.DIAMOND,of the Borough of East
Washington,Washington County,Pennsylvania,do hereby make my
Last Will and Testament,and revoke all Wills by me at any time
heretofore made.
FIRST:I direct my Executor hereinafter named to pay
my just debts,the expenses of my last illness and my funeral
expenses from the assets of my estate.
I direct that all inheritance,estate and other
taxes imposed as a result of my death,together with interest and
penalties thereon,whether or not the property ~o which such taxes
are attributable passes under this my Will,be paid out of the
principal of my residuary estate,without appor~ionment or right
of reimbursement;and I direct that my Executor pay such taxes at
such time or tines and in such manner as my Executor may deem
advisable.
SECOND:I specifically devise and bequeath the sum of
One Hundred Twenty Thousand Dollars ($120,000.00)to my Trustee
hereinafter named,in trust,nevertheless,for ~he following
uses and purposes:
(a)To hold,invest,and reinvest the same,
to collect the income therefrom and to pay the sum of Two Hundred
Fifty Dollars (~250.00)per month therefrom to my sister,NELL H.
BILBY during the remainder of her life.To the extent that the
income exceeds Two Hundred Fifty Dollars ($250.00)per month,
it shall be used,or accumulated to be used,fo~the post high
school education of my grandchildren.Upon the death of my
sister,NELL H.BILBY,the trust assets shall be divided into
two equal parts,Fund A and Fund B.The income and principal,if
necessary,from Fund A shall be used for the post high school
education (incl~ding tuition,books,room and board)of the
children of my son J.EDWARD DI~10ND.The income,and principal,
if necessary,from Fund B shall be used in a similar fashion for
the children of my son BRADLEY HAYDEN DIAMOND.When a grandchild
reaches the age of twenty-five (25)he/she shall be entitled
to receive a share of the principal equal to the number of my
grandchildren benefiting from his/her particular Fund.
Should my son,BRADLEY HAYDEN DIAMOND,
not have any children born to him and living upon his reaching
age fifty (50)or should he die prior to reaching said age with-
out living children to survive him,whichever occurs first,the
assets of Fund B shall be transferred into Fund A for the benefit
of the children Jf my son,J.EDWARD DIAMOND,and if,at that
time,a child or children has reached age twenty-five (25),an
equal share shall immediately be distributed to him/her.
Should my sister,NELL H.BILBY,pre-
decease me,then I direct that two separate trusts be created
($60,000.00 in each trust),entitled Fund A and Fund B and be
administered for the benefit of my grandchildren as hereinabove
set forth.
The disbursements made from the trust(s)
and any issues arising regarding same shall be resolved solely
in the discretion of my Trustee.
THIRD:I give,devise and bequeath the rest residue
and remainder of my estate,both real and personal and wherever
situated,to my two sons,J.EDWARD DIAJ10ND and BRADLEY HAYDEN
DIAJ10ND,in equal shares,share and share alike.
FOURTH:I hereby nominate,constitute and appoint as
the Executors of my estate:my son,J.EDWARD DIAMOND;my son,
BRADLEY HAYDEN DIAMOND;and the UNION NATIONAL BANK of PITTSBURGH;
I further direct that the aforesaid Executors also act as
Trustee or Trus~ees as they may be required to fulfill my inten-
tions as herein set forth;and I further direct that WRAY G.ZELT
III,ESQUIRE shall represent my Executors and Trustees.
