Sworn and Subscribed Before Me LAST WILL AND TESTAMENT OF ROMAINE M.DRISCOLL I,ROMAINE M.DRISCOLL,of Washington County,Penn- sylvania,being of sound mind and memory do make,publish and declare this my Last Will and Testament,hereby revoking and declaring null and void any and all Wills and Codicils by me at any time heretofore made. FIRST:I direct my Executors to pay my just debts, the expenses of my last illness and my funeral expenses. SECOND:I give and bequeath to my husband,GILES C. DRISCOLL,all of my household goods,furniture,furnishings, books,pictures,paintings,silver,chinaware,jewelry,auto- mobiles and all other purely personal effects,if any,which I may own at my death,provided,however,that if my husband shall fail to survive me for a period of Sixty (60)days,or if he should predecease me,I give and bequeath the aforesaid items to my daughter,AGNES E.DRISCOLL,or if she is not living,to my remaining children,then living,in equal shares. THIRD:In the event my husband,GILES C.DRISCOLL, fails to survive me (in the event that he and I die under circum- stances which afford no sufficient evidence as to who was the survivor,it is my intention that it be presumed that I survived him),I give,devise and bequeath that certain parcel of real estate at 385 Wilbert Avenue,Washington,Pennsylvania,together with all household furniture and furnishings therein contained to my daughter,AGNES E.DRISCOLL,if she survives me,in fee simple absolute.In the event,however,I do not own the said real estate at the time of my death,I give,devise and bequeath to my said daughter in fee simple absolute,if she survives me, the residence real estate,together with all household furniture and furnishings contained therein which I may own at my death. FOURTH:All the rest,residue and remainder of my estate,of whatever kind and wherever situate I give,devise and bequeath in the following shares to my following children: Twenty-Two (22)Per Cent thereof for my son,GILES C.DRISCOLL, JR.;Twenty-Six (26)Per Cent thereof for my daughter,MARYANN THOMPSON;Twenty-Six (26)Per Cent thereof for my daughter,AGNES E.DRISCOLL;Twenty-Six (26)Per Cent thereof for my daughter, MARGARET HOLLIS.If any of said children shall not survive me then the share of said deceased child shall pass to the living issue per stirpes of the deceased child. FIFTH:I direct my Executors to payout of the princi- pal of my residuary estate all Federal Estate,State Inheritance, or Estate and Succession Taxes imposed upon or with respect to my estate or any property in which I may have an interest,including any property not forming a part of my testamentary estate but included in my gross estate for tax purposes,except any property over which I have a taxable power of appointment in the event it shall be held that I have not exercised such power of appointment in this Will,at such times and in such manner as my Executors,in their discretion,shall deem advisable;and no such taxes,or any portion thereof so paid,shall be collected from or paid by any other person,persons or corporations by way of reimbursement, proration,apportionment or otherwise. SIXTH:I appoint my Four (4)children,GILES C.DRISCOLL, JR.,MARYANN THOMPSON,AGNES E.DRISCOLL,and MARGARET HOLLIS as Guardians of any property which passes to a minor and with respect to which I am authorized to appoint a guardian and have not otherwise specifically done so,granting them in this capacity the power to agree to any distribution of the said property that they -2- deem advisable;the power to retain any property,real or personal, received by them in kind and the power and authority to sell the same upon such terms and conditions as they believe advisable, giving good title to any real estate thus sold;and the power and authority to invest in such stocks,bonds and/or other in- vestments they deem advisable,without being limited to those investments in which guardians are by law required to invest minors'funds;and the power and authority to disburse to or for the benefit of the minor wards so much of the income and the principal of the minor's share of the said property as they in their sole discretion,deem advisable for the minor's comfort, maintenance,support and complete education,including preparatory, college and post-graduate or professional training,and to aid the minor in the event of any illness,injury or other emergency affecting the minor wards wherein money is needed. SEVENTH:I appoint my husband,GILES C.DRISCOLL,as Executor of this my Last Will and Testament.If my husband shall be unable or unwilling to serve then I appoint as Co- Executors my Four (4)children,GILES C.DRISCOLL,JR.,MARYANN THOMPSON,AGNES E.DRISCOLL,and MARGARET HOLLIS.If any of the aforesaid Four (4)children shall be unable or unwilling to serve as Co-Executor then no substitute shall be appointed. Neither my husband nor any of my children shall be required to file bond as Executor or as Guardian.
