LAST WILL AND TESTAMENT
OF
EDWARD T.BEEDLE,JR.
I,Edward T.Beedle,Jr.,of the Borough of Canonsburg,
Washington County,Pennsylvania,being of sound mind,memory and
understanding,do make and publish this,my Last Will and Testa-
ment,hereby revoking and making void all former wills by me at
any time heretofore made.
FIRST.I direct that all my just debts and funeral
expenses be paid as soon after my decease as may be found conven-
ient.
SECOND.All the rest and residue of my estate,real,
personal and mixed,I give,devise and bequeath to my wife,Zoe
Bell Beedle,to have and to hold the same for and during her
natural lifetime,with the right to use and consume so much there-
of as she may desire,without any limitation whatsoever and with-
out being required to give security for any property coming into
her hands.
THIRD.At the death of my said wife,it is my will
and I hereby direct that whatever may then remain shall be divided
as follows:
(1).One full third part thereof I give,
devise and bequeath to my niece,Reo Jean Heeter,to be hers
absolutely and forever.
(2).Two full third parts thereof I give,
devise and bequeath to my son,E.Tom Beedle,to be his absolutely
and forever.
FOURTH:It is my will and I hereby authorize and
empower my Executors to sell any and all my real estate at any
time they may be requested so to do in writing by my said wife,
and in the event that my real estate should remain unsold,at
the time of her death,then the surviving Executor is hereby
authorized and empowered to sell the same and distribute the
proceeds thereof to and between my above named son,E.Tom Beedle,
and my niece,Reo Jean Heeter,as provided in the "THIRD"item
of my Will.
FIFTH:My brother,Fred A.Beedle,and I,entered
into a partnership agreement on September 1,1947,said agreement
replacing and superseding a partnership agreement entered into
on February 15,1937,and at present we are carrying on such
partnership agreement under the firm name of "BEEDLE BROTHERS".
I direct my Executors,as soon as conveniently may be after my
death,to concur with my brother,in winding up the partnership
business,and I authorize and empower them to make any arrangemen s
which to them shall seem fitting and reasonable,for the settle-
ment and adjustment with my brother,as the surviving partner,of
all my rights and liabilities in respect of said business,with
full power to make any arrangements for giving time to my surviv-
ing partner and for accepting payments from him as may be thought
proper and if they see fit so to do,to allow any or all my interest
in said partnership to remain as an interest bearing loan,as may
be agreed upon between them,and generally to act in the premises
in such manner as they shall think proper,without being answer-
able to anyone for any loss which may be occasioned thereby.
This wide discretion is given my Executors for the purpose of
allowing they and my brother,Fred A.Beedle,to arrive at such
amicable adjustment of our partnership affairs as to them might
seem most.desirable,particularly in those instances where a
strict adherence to the terms of the partnership agreement might
work an unjustifiable hardship upon,or cause irreparable injury
to the surviving partner.Nevertheless,if they shall so desire,
nothing herein contained shall be taken to prevent my said Execu-
tors from requiring a complete compliance with the aforementioned
partnership agreement in all respects.
And I do nominate,constitute and appoint my wife,Zoe
Bell Beedle,and my son,E.Tom Beedle,Executors of this,my
Last Will and Testament.
IN WITNESS WHEREOF,I,Edward T.Beedle,Jr.,the
testator,have to this,my Last Will and Testament,containing
three typewritten pages,set my hand and seal this twelfth day
of October,A.D.one thousand nine hundred and forty-nine.
Signed,sealep,published and declared by the above
named testator as and for his Last Will and Testament,in the
presence of us,Who,at his request,and in the presence of
each other,have hereunto set our hands as witnesses thereto.
