FOURTH:In the event that my brother,R.Maxwell Cummins,shall not be alive at the time of the probate of this my Last Will and Testament,I then give,devise and bequeath all my estate as follows: (A)In the event that I am buried in the Mt.Pleasant Cemetery at Hickory,Pa.,I give and bequeath to the said Mt. Pleasant Cemetery Association,Hickory,Pa.the sum of $500.00 without ieduction for Inheritance tax,to be invested and the interest therefrom to be used for the upkeep of the lot or lots in which my immediate family,consisting of father,mother, sisters ~nd brothers may be buried;in the event,however,that I ma buried in the Center Cemetery near Midway,Pa.,I then give and bequeath the said sum of $500.00 to the Center Cemetery ... Association,Midway,Pa.without deduction for Inheritance Tax, which sum shall be invested and the interest derived therefrom shall be used for the upkeep of my lot in the Center Cemetery. (B)The balance of my estate,after payment of legacy under (A)above,I direct shall be,divided :i!nto five (5)equal shares or parts,and the said shares or parts shall be divided among my niece and nephews as follows: To my nephew,Clark Aiken,I give and fievise one share or part,absolutely.
