Attorney.
I,George VI.Hess,ot South union Township Fayette
County and state of pennsylvania,being of sound mind and dis-
posing memory,and considering the uncertainty of this mortal
life,do make and pUblish this my last will and testament;hereby
making void all former wills by me at any time made.
First.I direct that all my just debts and funeral
expenses be paid by my EXecutors,and a good decent tombstone be
put up at my grave.
Second,I give and bequeath to my beloved Wife,Mary L.
all my household and kitchen furniture.It is also my will that
she receive the dividends arising from twenty (20)shares of stock
ot the South west pennsylvania Railroad co.to be collected by
my Executors and to be paid to her as received.It is also my
will that she receive the dividends arising trom ten (10)shares
ot the stock of the Second National Bank ot Uniontown pa.to be
collected by my Executors and to be paid to her as received.I
further dire ct my Executors to invest F1f'teen Thousand Dollars
(15000.)and to pay the interest therefrom to my said wife
annually or often as received,during her lite or as long as she
rem~1ns my widow.I further direct that one hundred Dollars (100)
annUally ot the dividends arising from my ten (lO)shares of stock
in the First National Bank of Uniontown Pa.be collected by my
Executors &by them be paid to my said Wife,as received,during
her'lite,and so long as she remains my widow.
ihird.I give and devise to my said wite Mary L.Hess
the use,possession and control ot my lot of land,mown as lot
NO 77 in Gilmore's addition to Uniontown pa.on Ben Lomond st.
for &dving hel'natural lite and as long as she remains my widow.
The foregoing provisions in favor of my beloved wife are
in lieu of her rights under the law,and in lieu of dower:
Excepting her however her $300 -widow's exemption.
Fourth.I give and bequeath to my beloved daughter
Laura B.intermarried with Monroe Hopwood,the sum of Ten thousand
(10,000.)Dollars;also,at the death of her mother,twenty shares
(20)of stock of Southwest pennsylvania Railway stock,and ten
shares (10)of stock of Second National Bank of uniontown pa;
also,at the death or remarriage of her mother,the sum of Twelve
thousand five hundred (12$00)Dollars of the $15000 to be held
and invested by my Executors as above provided;
I also give &devise to my daughter Laura B Hopwood the
residence property on South Mt.Vernon Avenue,uniontown pa
Which I purchased from Joseph Strickler,to be hers in fee simple;
I also give and devise to said Laura B.Hopwood,in fee simple,my
undivided interest or share in a bG~7 of coal of about 20,000,
acres more or less in west Virginia and in Richhill Township
Greene county penna,and west Finley Township,Washington county,
Penna,and known as the Wheeling creek Coal field,my undivided
share being equal in severalty to about five hundred ($00)acres;
with mining and other rights appurtenant,as owned by me;also any
interest in land or surface connected therewith as owned by me.
Fifth.I give and bequeath to my be~oved son,John
Ellsworth Hess,ten (10)shares of the stock of the First National
Bank of Uniontown pa,subject however to my wifets right to
one hundred dollarsi(~OO)of the dividends each year,as above
provided;I also give to him a bond calling l'or pa,ment of ~rty
s1x '!housand (36,000)dollars by the e11nton Land Co,secured by
mortgage,or so nmeh thereot as is unpaid at my death;I also give
him,at the death or remarriage or his mother,twenty five hundred
dollars (2,500)or the $15000.-directed to be held and invested b1
my Executors as above.
I also give and devise,in tee simple,to said John
Ellsworth Hess,said lot No.77,in Gilmorets addition to uniontown
pa,to have and possess the same from.and after the dea.th or
remarriage of his mother,said M8.1'1 L.Hess.
I also give and devise to said John Ellsworth Hess,in
tee simple,the t.ract ot land in South Union Township,said
Fayette Co pa on the Na.tional Pike,on which I now li.fe,and
which I purchased from J V Thompson and John A Niccollts Estate;
I also give and devise to my said son,my undivided
interest,being one sixth,in the coal tracts mown as Swan,
Hackney &wood tracts,in Luzerne &Redstone Townships,Fayette
Co pa.;also my interest or share in the tracts on or near Dunlap
creek in said Redstone Township,known as the Clark R.Hess,the
Dunaway,and other tracts,as per deed to me or record;intending
hereby to g1ve to him all the coal I may own in Fayette county pa;
but in case I sell any ot said coal in my lit'etime then I give to
my said son the proceeds ot such sales or the equivalent thereof.
Sixth;I give and bequeath one thousand (1000)Dollars
to my grandson George W Hess,son of John Ellsworth Hess,to be
expended however by my EXecutors in his education,under the
direction ot his tather,and without the appointment or a gt1ard1an.
Seventh.I g1ve &bequeath one hundred dollars (100)
to my nephew George Hess,son or my brother John F Hess,to be
paid within one year after my death.
Eighth.ihe remainder of my Estate,real personal &
mixed,I give equally to my daughter Laura B &My son John
Ellsworth.
Ninth.I appoint J V.Thompson and my son John
Ellsworth Hess Executors of this my last will &testament.
