Register IAST WTI.L AND TESTAMENl' I,:FRANK B.DIMMACK,of South Strabane Township,Washington County,Pennsylvania,being of sound mind,memory and umerstand ing,do hereby make and publish this my last Will and Testament,hereby revoking all Wills II by me at any time heretofore made. I ITEM 1:I direct that my Executrix hereinafter named shall pay all of my just debts and funeral e:xpenses as soon as convenient after my decease. ITEM 2:I give and bequeath my automobile,clothing and other purely personal effects,as well as such household goods and equipment which I may own,unto my wife,Eleanora T.Dimmack,if she survives me. ITEM 3:I give,devise and bequeath the residue of my estate of whatever kind and wherever situate as follows: A.Unto my wife,Eleanora T.Dimmack,the one-half (1/2)th.ereof. B.The remaining one-half (1/2)thereof,I give, devise and bequeath unto Pittsburgh.National Bank to be held in trust in accordance with the following provisions: (a)ltr Trustee shall pay the income unto my wife, Eleanora T.Dimmack and my son,Frank B.Dimmack,Jr.,or for their respective benefit in semi-annual installments and in the event of the incapacity of my wife through illness or otherwise,my Trustee shall be authorized to disburse to her or for her benefit so much of the principal as my Trustee shall deem advisable for her comfort,maintenance and support and to aid her in the event of arw circumstance or corrJition affecting her wherein money is needed. The distribution of income shall be mde by my said Trustee to my wife and son in such.proportions as my said Trustee,in its sole discretion,deems advisable,such payments to continue for and during the life of my said wife. Further,my Trustee is authorized to pay and distribute to my said s on,Frank B.Dimmack,Jr.,or for his benefit,so much of the principal of said trust as ~Trustee in its sale judgment deems advisable from time to time for his health,maintenance,support and complete education includi~preparatory, college and post graduate or professional training.~Trustee shall be under no obligation to equalize the payments of income or principal from said trust to my said wife and son,for it is my intention to specifically authorize by the terms of this paragraph,unequal distributions as made in the sole discre- tion of my said Trustee. (b)Upon the death of my wife,Eleanora T.Dimmack,said trust shall continue until ~son,Frank B.Dimmack,Jr.,shall attain the age of twenty-five (25)years or complete his education including post graduate or professional training,at which.time the balance remaining in said trust shall be distributed to my said son. ec)Neither the principal nor the income of this trust held in tbe hands of my Trustee shall be liable for the debts of the beneficiaroes thereof,nor shall the same be subject to seizure or attachment by any creditor under any writ or proceeding at law or in equity and shall not be assignable by the beneficiaries h.ereof. LASTLY:I name,constitute and appoint as Executrix of this my Last ilTill am Testament,my wife,Eleanora T.Dimmack.In the event that my said wife for any reason should be unable to act,then I name,constitute and appoint Pittsburgh National Bank as Executor of this my Last ill and Testament and direct that my personal representative shall not be required to furnish bond in any jurisdiction. unto this my April,1967.
