J.G.Carroll Attorney. • I,Robert M.Carroll,attorney,of the city of Uniontown~ayette County,Pennsylvania,do hereby make,publish and declare the following writing to be my last Will and Testament,hereby revoking any and all Wills heretofore made by me. First:-I hereby direct my Executrix hereinafter named to col- lect all outstanding obligations due me,and to pay my just debts and funeral expenses as soon after my decease as there are funds available therefor,and in case of insurficient money on hand to pay said debts and funeral expenses,to sell at public or private sale,such personal or real estate as may be necessary to make up the deficiency;and in case of sale of real estate for such purpose,to make deed or deeds therefor without order of Court. Second:-That in order that the home may be preserved at least during the minority of our children,all the rest,residue and remain- der of my estate,real,personal and mixed,and wheresoever situate,I give and devise and bequeath to my dear wife,Katharine Carroll,for and during the term of her natural life,or while she shall remain my widow;and in case of insufficient income,with authority to sell at public or private sale,at such time"or times,such part or parts there- of,and in case of real estate,to make deed or deeds therefor for the proper conveyance thereof,without order of Court:as may be necessary for maintenance,to pay taxes,insurance,repairs,replace old or ac- quire reasonably necessary new furniture,other expen&es incidental to a home and for the maintenance and education of our children;with the further rignt~f a change of residence should be desirable,to sell our present residence at public or private sale without order or Court and invest the proceeds,or a part thereof,in another property for residence. Third:-Upon the death of my said wife,all my estate r~g, real,personal or mixed,I give,devise and bequeath to my children, share and share alike,provided that in equalizing my said children, their ages~maintenance and costs of education at college shall be taken into consideration,the object being that all shall share equally,and in case of the re-marriage of my said wife,she shall receive the one-third of the remaining property,real,personal and mixed,and the above provi- sions relative to my ~hildren,shall apply to but two-thirds of my re- maining estate~and further,should any of my children at the time of. the death or re-marriage of my said wife~e under the age of twenty-five years,The Court shall appoint a Guardian or Trustee to hold their,money and accumulations thereof until they arrive at the age of twenty-five years respectively.
