ITEM I.I direct that all my just debts and funeral ex- penses be paid out of my estate as soon as practicable after my decease. ITEM II.Having in mind my beloved wife,ANN DZIAK,and feeling confident of her ability to manager her affairs,I do hereby give,devise and bequeath all my property,be it real, personal,or mixed and wheresoever the same shall be situated, unto my beloved wife,ANN DZIAK,absolutely and in fee simple, provided that she survive me for a period of thirty (30)days after my demise. ITEM III.If,however,my beloved wife,ANN DZIAK,should predecease me,or should follow me in death within thirty (30) days,of my demise;then I give,devise and bequeath all my property,be it real,personal or mixed and wheresoever the same shall be situated unto my beloved children,JULIANN ,FRANCES, ANNETTE and MARY-SUE,and any child or chll.dren who may be born hereafter,equally,share and share alike per stirpes,absolutely and in fee simple,except that such shares of such children as shall be minors at the time of my decease shall go to such guard- ian as is nominated by the executrix of this,my Last Will,and Testament,and is approved by the Court,in trust and for the purposes as listed in Item IV.of this My Last Will and Testament. ITEM IV.In the event that my beloved'W1fe,ANN DZIAK,should predecease me or fail to survive me for a period of thirty (30) days after my demise,then it shall be my last will and request that the guardian of my minor children as so appointed in a previous article of this~my Last Will and Testament~shall serve as such guardian of such minor children reach the age of majority~as such guardian~she shall have full power and authority to and shall receive the shares of my estate of such children,as shall be minors at the time of my decease. It is further my will that no distribution to any child- ren shall be made from my estate until such time as my last daughter shall become self-supporting,emanciapted or graduates from college or be comes a nun.At that time,the distribution may be made to all of my children.However~during the time that my last mentioned child is attaining the age of majority, it is further my will that distribution from my estate may be for the support of her and of any of my other children,who not of age,not emancipated or not self-supporting.In the event that such minor children shall die before reaching the age of majority without issue surviving,the balance of such childs share of my estate shall be divided among the surviving children equally,share and share alike~as provided in this and the proceeding subsection of this my Last Will and Testa- ment. In the event that such minor childs death before reaching the age of majority with issue surviving~then such childs share balance shall be distributed among such children surviving equally~ share and sh~e alike. ITEM V.I nominate~constitute and appoint my beloved wife~ ANN DZIAK~as and for the executrix of this my Last Will and Testa- ment and express the wish that Letters Testamentary be issued to her without bond.I direct that the formal appraisement be dis- pensed with insofar as it may be lawfully done. I hereby authorize and direct my said executrix~ANN DZIAK~ at any and all times from and after my decease to assign~bargin~ sell,convey,transfer,deliver,invest,re-invest,release or otherwise dispose of or deal with all and singular my estate (including the power to vote,transfer,or otherWise deal with any and all corporations or stocks)as if she were the unconditional owner thereof,for such purposes and on suchterms or conditions as she may deem advantageous to my estate or conducive to the beneficient administration thereof; and to execute,acknowledge and deliver any and all instru- ments of conveyance or transfer,powers of attorney,proxies, or other papers deemed necessary to the plenary exercise of the powers in or by this,my Last Will vested in or conferred upon her. And,I authorize my executrix at any and all times to compound,compromise,or otherwise settle or adjust any and all charges,claims,debts and demands,whatsoever,against or in favor of my estate,and in any manner and on any terms or conditions as she may believe just or expedient. ITEM VI.In the event that my beloved wife,ANN DZIAK, shall predecease me,I do hereby constitute and appoint my beloved daughter,JULIANN ,as and for my executrix of this my Last Will and Testament and express the wish that Letters Testamentary be issued to her without bond and that she be given the same power and authoritYffi given to my wife to ad- minister to my estate.
