LAST WILL AND TESTAMENT OF WILLIAM H.HOGSETr
I,William H.Hogsett,a resident of Uniontown,Fayette
County,Pennsylvania,being of sound mind and memory,do make,
publish and declare this my last will and testament.
FIRST:I direct that all my just debts and funeral
expenses be paid as soon after my decease as may be found con-
venient.
SECOND:I give and bequeath to the First Fresbyterian
Church of Uniontown,Fayette County,Pennsylvania,the sum of
One Thousand ('1,000.00)Dollars,same to be used for suCh pur-
poses and in such manner as the Board of Deacons of said ChurCh
may direct.
THIRD:I give and bequeath .2!.my sisters,Jane
Messmore,Susan Hogsett and Harriet G.Shaw,each the sum of
Five Thousand ($5,000.00)Dollars.
FOURTH:To my brother,John F.Hogsett,Jr.,I give
and devise my interest,same being an undivided one-half interest
in and to all that certain tract of land,same being accurately
described in Deed of record in the Recorder's Office of Fayette
County,situate on Mill Street,Uniontown,Fayette County,Pennsyl-
vania,and upon which is erected the building known as Hogsetts'
Mill,and a residence known as No.40 Mill Street,and commonly
known as the Mill Froperty,same to include the land and buildings
erected thereon,machinery and equipment in said buildings and
attached thereto as a part of the plant,but not to include the
business,book accounts,merchandise,stock or personal property
belonging to or used in connection with the said business known as
J.F.Hogsett &Sons.
FIFTH:All the rest,residue and remainder of my
estate,real,personal and mixed,of whatsoever nature and
wheresoever situate,I give,devise and bequeath to my wife,
Elizabeth C.Hogsett,absolutely and forever.
SIXTH:It is my desire that my brother,John }f'.
Hogaett,Jr.,be given the privilege of purchasing my undivided
one-half interest in the flour and feed business known as J.F.
Hogsett &Sons,and conducted at No.48 Mill Street,Uniontown,
Fayette County,Pennsylvania;and I direct that my said brother,
John F.Hogsett,Jr.,and my wife,Elizabeth C.Hogsett,make,or
cause to be made,a fair and accurate inventory of said business,
including all merchandise,stock,fixtures,book accounts,all
personal property used,or intended to be used,in connection
with said business,as promptly as may conveniently be done after
my decease;and that my brother,John F.Hogsett,Jr.,be given
the option,or privilege,for a period of ninety (90)days after
the completion of said inventory,of purchasing my said interest
for the price,or amount,of said inventory;and in case he elects
to purchase same for said amount,he shall,within the said ninety
(90)days,make,execute and deliver to my wife,Elizabeth C.
Hogsett,his promissory note containing Power of Attorney to Con-
fess Judgment,and due and payable within three (3)years from
date,with interest thereon at the rate of four (4)per cent per
annum,for the amount of said purChase price,and she shall,upon
receipt of said note,make,execute and deliver to him,a proper
Bill of Sale for my undivided one-half interest in said business.
SEVENTH:I hereby nominate and appoint my Wife,
Elizabeth C.Hogsett,and my brother,John F.Hogsett,Jr.,as
Executrix and Executor of this my last will and testament.
IN WITNESS WHEREOF,I have hereunto set my hand to
this my last will and testament this 15 day of April,1940.
