LAST WILL AND TESTAMENT OF ALBERT S.DEVORE I,ALBERT S.DEVORE,a resident of the City of Monongahela,Washington County,Pennsylvania,being of sound mind and memory,hereby revoke all wills and codicils,as well as all instruments of a testamentary nature heretofore made by me,and do hereby make,publish and declare this to be my Last Will and Testament in manner and form following: FIRST:I direct that all my just debts,funeral and testamentary expenses shall be paid by my Executor hereinafter named,as soon as conveniently may be after my death. SECOND:I give and bequeath the sum of Five Thousand ($5,000.00)Dollars to my nephew,James Devore,Sr.,of Peters Township,Washington County,Pennsylvania. THIRD:I give and bequeath the sum of Ten Thousand ($10,000.00)Dollars to Western Pennsylvania National Bank, McKeesport,Pennsylvania,its successors and assigns,in trust nevertheless,for the use,benefit and profit of my grandnephew, James Devore,Jr.,also of Peters Township,Washington County, Pennsylvania,for the following uses and purposes: (a)To accumulate the net income of all of said trust estate until my grandnephew,James Devore,Jr.,shall have arrived at the age of twenty-one (21)years,and when my grand- nephew,James Devore,Jr.,shall have arrived at the age of twenty-one (21)years,the trustee shall pay the net income there- from in convenient installments to my said grandnephew,until he attains the age of twenty-five (25)years,at which time it shall then pay over the principal of this trust fund,discharged from this trust. I \ I I' i I I (b)Should my said grandnephew,James Devore,Jr., during his minority or during the term of this trust,desire to attend college,graduate or professional school,the said trustee shall have the right to withdraw installments of principal and pay over to him from time to time,for the tuition,books,fees, I maintenance,comfort and general welfare of the said James Devore, I I Jr.,during the time that he shall be regularly enrolled in an I institution of higher learning.The necessity and propriety of such withdrawals,and the amount thereof,shall be determined by the trustee,and its determination shall be final. FOURTH:All the rest,residue and remainder of my estate,real,personal and mixed,wheresoever situate,of which I may die seized or possessed,or over which I may have testamentary control,or to which I may be in any way entitled,of whatsoever the same may consist,I give,devise and bequeath to my wife, Wilma Devore,her heirs and assigns.
