RealiZing the frailty of life and the fact that I may not be ontinued in life muoh longer,I make this my last will and testame, o effeot an equitable division of my property after I am gone. II I will that after all debts are paid that my property be diVided into three equal parts one to go to eaoh of the members of my family, thel R.Barr my wife,John A.Barr,my son,and Martha Jane Barr, my daughter,exoept that sixteen hundred dollars shall be deducted from John's share and divided equally between Ethel my wife and artha my daughter.I make this exception because of the expense 0 John'S eduoation. On the 25 day of April,A.D.,1939,an order in said oause was made, an entry of which appe rs on the Journal of said ourt,Vol 77,page, 456 in the words and figures as follows,viZ: BARR,JOHN ELMER,DECEASED ) )ORDER,AD ITTING TO PROBAE AND.RECORD IN RE ESTATE OF ) This matter came on this day to be heard,on the application of Ethel R.Barr,to admit to probate and reoord the Will of John lmer Barr,d ceased,late of the Village of New Conoord,in said County, heretofore fil d in this Court. It is now shown to the satisfaotion of the Court that said I deoedent died leaving Ethel R.Barr,his surviving spouse,and that the surviving spouse and all the next of kin of said deoedent known to be resident of the State,have waived notioe and given oonsent I to the probate of said Will. And Paul E.Martin and Marjory B.rtin,the subsoribing witnesses to said Will,this day appeared in open Court,and having been duly sworn testified respeotively to the due exeotuion and attestation of said Will,whioh testimony was reduced to writin~, was subscribed by them respeotively,and was filed with said Will. Whereupon the Court finds that the aforesaid instrument of writing is the last Will and Testament of said John Elmer Barr, deoeased,that it was dUly exeouted and attested;and that the said testator at the time of signing said Will,was of full age,of sound mind and memory,and not under any .estraint.
