nia~o make~ublish and declare the following to be my last will
and testament~ereby revoking all former wills by me at any time
heretofore made:
FIRST.I hereby direct that all my just debts and funeral
expenses be paid out of my estate by me hereinafter named executors
as soon after my decease as can conveniently be done.
SEC ND.I give and bequeath unto my beloved wife~auretta
Hagerty for and during her lifetime or so long as she may remain my
widow the use and income from the undivided one-half of my land~ituate
partly in edstone and partly in Menallen townships~ayette County,
Pennsylvania~d aggregating about one hundred ninety acres~d
composed of two contiguous farms~n one of which I now reside~nd
upon the death or remarriage of my said wife said undivided one-
half of said land I give and devise to my son~obert C.Hagerty~s
heirs and assigns~d the,other undivided one-half of my said land
I give and devise to my said son~obert C.Hagerty,his heirs and
assigns~o be his immediately upon my decease~ubject however to
his paying~on the death or remarriage of my said wife~he sum
of one thousand dollars to the then living children of my daughter,
Violet E.~cCay~hare and share alike.
THIRD.I give and bequeath to my said daughter~iolet ~
McCay,one cow and one horse~he selection of which to be mutually
agreed upon by my said son and daughter.
FOURTH.I give and bequeath to my said wife and my said
son in equal interests and absolutely all farming implements~rainof
every kind~ousehold goods~urniture and articles~d all livjL
!tock~ot hereinbefore bequeathed~n my farm and premises.
FIFTH.I hereby direct my executors hereinafter named to
invest out of my estate the sum of Twelve thousand dollars in good and
safe securities and to pay the annual interest arising therefrom
to my said wife annually or semi-annually as convenience may dic-

tate for and during her natural life~nd at her death the said
principal shall go to my said son and daugh~er~hare and share
alike.L
SIXTH.I hereby authorize~mpower and direct my executors
hereinafter named to sell and by a good and sufficient deed or deeds
to convey to the purchaser or purchasers any and all of my coal lands
and mining rights that I may own at the time of my death wherever
situate~nd to sell same at private sale~and at such time and at
such price and upon such terms of payment as my said executors in
their sound discretion may deem most beneficial to my estate~nd
the proceeds arising from the sale of my said coal and mining rights
I give and bequeath to my said son and my said daughter in equal
portions.
SEVENTH.All the rest and residue of my estate not herein-
before disposed of~hether real~ersonal or mixed~and wherever situate,
I give~equeath and devise to my said son,Robert C~agerty~d my
said daughter.LYiolet E.McCay~heir heirs and assigns.L!n equal por-
tions.In case of death of either or both their children to take
their parents share.
EIGHTH.The portion of my estate which I have hereinbefore
given to my said wife shall be in lieu of dower,which the intestate
laws give to widows of intestates.
NINTH.I hereby constitute and appoint my son~obert C~
Hagerty,and my son-in-law~ames E.McCay~xecutors of this my last
will and testament~d as such shall receive from my estate the sum
of one hundred dollars each for their services.

this 30th day of April A.D.1910.
