FIRST:I desire that an inventory and appraisement of all my estate,real,personal and mixed,be made as soon after my death as is convenient,by two competent persons to be selected and appointed by my executors hereinafter named. SECOND:I direct that all my just debts and funeral expenses be paid out of my estate as soon after my death as may be convenient. THIRD:I give and bequeath to my grandson,William H.Binns, Jr.,my gold watch and chain and the sum of Fifty ($50.00)Dollars. FOURTH:I give and bequeath to my granddaughter,Elma E. Binns,the Paisley Shawl which was formerly the property of my wife, and the sum of Fifty ($50.00)Dollars. FIFTH:I give and bequeath to my daughter-in-law,Janet McK.Binns,the sum of Two Hundred ($200.00)Dollars. SIXTH:I give and bequeath to my daughter-in-law,Elizabeth P.Binns,the sum of Two hundred ($200.00)Dollars. SEVEN'IH:I give and bequeath to my daughter-in-law,Ethel C.Binns,the sum of Two Hundred ($200.00)Dollars. EIGHTH:I give and bequeath to our housekeeper,Ustie Uchelvich,the sum of One hundred ($lOO.OO)Dollars,in consideration of her faithful serVices,only in case,however,she remains our housekeeper until my death. • NINTH:I give and bequeath to my nephew,Charles S.Binns, the use of,and income from that part of my house and lot at No. 98 Warren Street,Columbus,Ohio,now used by him,so long as he may live and occupy the same,said Charles to be liable for all expense for taxes and repairs.And if the said Charles should at any time prefer to live elsewhere,my executors may rent said house and lot and pay the income therefrom,less said expenses,to the said Charles S.Binns,so long as he may live;or,in such case, my said executors may,at their discretion,sell and dispose of said house and lot,invest the proceeds of such s ale in sound interest bearing securities,and pay such interest,less any proper expenses thereon,to the said Charles S.Binns.And if the said house and lot,or the proceeds or any part of the proceeds of the sale thereof,shall remain after said Charles'death,the same shall revert to and become a part of my residuary estate. TENTH:I give and bequeath to my son,David H.Binns,all interest I may hold at the time of my death in any and all house- hold furniture,farm implements and livestock in or about the home farm,with the request that he divide some portion of the same (having particular reference to family heirlooms,etc),to and among his brothers,Willits,James and Benjamin.And I have full confidence tha.t my four sons will effect such distribution amicably and to the satisfaction of all parties at interest. ELEVENTH:All the rest,residue and remainder of my estate, of whatsoever kind and wheresoever situate,I give,devise and bequeath to my four sons,Willits C.Binns,James G.Binns, ..... Benj~in G.Binns and David H.Binns,share and share alike,the same to be distributed in cash or in kind,as my executors may think most advisable. TWELFTH:I desire that in case my executors are not ready to make complete settlement of my estate within the lawful time limit required,they be allowed a longer time,as certain of my properties, such as coal lands and rea estate,may require this delay.However, it is my wish that all special legacies herein made shall be paid, without any deduction for taxes or otherwise,as soon after my decease as may be possible.And also that such portion of residuary bequests as can be,be paid as soon after my death as is convenient. It is my desire and I hereby direct that my executors be not required to file an inventory and appraisement,nor account in any way or manner to the courts,but simply that an appraisement and account be made and presented to my residuary legatees for their inspection and approval. My further desire is that my executors take and accept the sum of One hundred ($100.00)Dollars each for their services as executors of this my last will and testament,and that their settle- ment of my estate be accepted by my heirs in an agreeable and satisfactory manner. THIRTEENTH:I hereby nominate and appoint my two sons,James G. Binns and David H.Binns,to be the executors of this my last will and testament,and I hereby authorize and empower them to sell and ..- dispose of such of my real estate and personal property as they may think best so to do,at either public or private sale,and to make and execute all such deed,deeds or instruments of writing therefor as will be necessary for the transfer of the same,and also to do and perform all other matters and things necessary for the complete settlement of my estate.
