I~James Elder Barnett of East Washington,Pennsyl-
vania,do hereby make and publish this as my last Will and
Testament and revoke any and all wills by me hitherto made.
My just debts are to be paid and a modest memorial
erected.
I give,devise and bequeath as follows:
ITEM 1.To my nieoe,I~8.Margaret Boyd Howard,an
antique dining table,red decanter and glasses,panel painted
by Margaret B.Barnett,willow tableware set.Portrait
Margaret B.Barnett in my bedroom to be given to Margaret
Barnett Howard.
ITEM 2.To Mrs.Ella Barnett Finley,her heirs and
assigns,oashmere rug in library,round table and Manila
oover in parlor,antique desk in library,large silver
pitcher in dining room,bottle inlaid with silver,brass
door knocker,a Buddha in library,deluxe edition of
Pennsylvania Archives,folio set of Shakespeare in parlor,
small bookcase in library with books,Chinese chest in
upper hall,tall mirror In office,rose painting in parlor
by M.B.Barnett,glass door wardrobe in guest room and
papers and D.A.R.belongings of Margaret B.Barnett,ship's
bell and bow running light,desk made by Grandfather Barnett,
and filing case in upper hall.
ITEM 3.To M.Olive Barnett,her heirs and assigns,
all dining room furniture,excepting victrola,paintings
and articles otherwise herein disposed of,large divan in
library with ohairs to match,bookcases on North and West
side of library with books not otherwise disposed of here-
in,Bokhara rug,brown marble-top table,furniture in guest
roam exoept wardrobe and rugs,large mirror above mantel
in library,cedar chest in my bedroom and oontents of
both chiffonier and desk in den and set of gold band table
ware.
ITEM 4.To Nancy E.Barnett,her heirs and assigns,
Shirvan rug,bookcase in northeast corner of parlor with
contents,except Shakespeare folios,shaker and goblets in
dining room,small mirror on mantel in library brought from
Malolos,P.I.,oommissions in upper hall and elsewhere,
Encyolopedia Britannioa in Pittsburgh office and volumes at
home,studio oil painting in library,camphor chest in attio.
ITEM 5.To Ralph P.Barnett,his heirs and assigns,
all guns and revolvers,except as otherwise prOVided,swords,
Spanish,presentation and my own,Filipino watoh and field
glasses,Borchardt automatio,carried by me in Phillippines,
Resolution presenting desk by Legislature of Pennsylvania,
small silver pitoher from Severn River Club,silver topped
and English tobacoo jars,all pipes and cigarrette holders,
and all cameras.

IT&M 6.To Charles A.Finley,his heirs and assigns,
any interest I may have in any boats or houseboats in Maryland
and Virginia and all tenting and outing equipment,inoluding
all fishing rods and 38-calibre Coltl s revolver,green glass
tobacoo jar,Chinese bathrobe and set of steins.
ITEM 7.To ~!rs.Nettie E.Larimer and Marguerite M.Elder,
their heirs and assigns,oocasional chair,old Bible,tortoise
shell in library,oil painting over viotrola in dining room
and oil painting of rural scene hanging in parlor,dresser and
wash-stand in office and bureau now in cellar.
ITEM 8.To Mary Jane StraWder,my housekeeper,who has
made my home oomfortable for more than thirty years,I give
and bequeath the contents of her room,all kitchen and cooking
utensils and equipment,electrio washing maohine,wringer and
all washing aooessories,boilers,buckets,oellar stove,etc.;
electric refrigerator,kitchen stove and cabinet;all canned
goods in glass or tin inoluding jellies;oomplete set of flat
silverware except old pieces;all table covers and napkins;
such glassware as she may need or desire to amount in discretion
of my executors;rugs and carpets in upper and lower hall;all
blankets,sheets and bed furnishings except in guest room;such
chairs as are not otherNise disposed of;original set of willow-
ware and such other tableware as my executors may desire;daven-
port in offioe,rugs in den,parlor and dining room;the
victrola and large mirror in parlor are hers:bed in my bed room:
she has possessions of her own in the attic and the above are in
addition to anything I have heretofore given her and as to that
her word shall be taken:she shall also have former serving table,
and small desk and bookcase in upper hall.
Further,I hereby give and devise to my executors and
trustees hereinafter named a life estate in the house and lot at
No.342 East Beau Street,Borough of East Washington,Fa.,in
trust nevertheless,under their superVision and with the restric-
tion hereinafter imposed,for the proper use and benefit of the
said Mary J.Strawder for the term of her natural life,to be
oooupied by her or rented for her by the said trustees as she
may desire,the restriotion above named being that should she
marry the said life estate shall immediately terminate,and
she shall have the right to remove suoh artioles as are given
to her absolutely.
Should she occupy the house she shall have the use of the
follmving articles of furniture subject to usual wear and tear:
In my bedroom,chiffonier,dresser,washstand and ohairs;
in den,ohairs,couch,desk,chiffonier but not oontents of
either;and suoh other artioles as trustees may designate.
Should she desire the trustees to rent the property for
her she shall receive during such period the excess of rental
over taxes and repairs,not,however,to be less than Twanty
Dollars ($20.00)per month.
Should she die before this Will beoomes effeotive these
bequests all become null and void and lapse into my residuary
estate.
ITEM 9.I hereby give,devise and bequeath to M.Olive
Barnett,her heirs and assigns,the remainder in fee to the
said house and lot at 342 East Beau Street,East Washington,Fa.
ITEM 10.To the Washington County Historioal Sooiety I
give and bequeath my Filipino and Japanese oolleotion to be
suitably marked as the Col.James E.Barnett oolleotion,
inoluding Chinese weapons from the Boxer Rebellion presented
by Senator Quay;military pictures of the lOth Fa.including
framed one of last Review of the lOth at the Presidio and
any negatives taken by Col.Geo.Nox MoCain upon return of

ITEM 11.I give and bequeath to the State Museum at
Harrisburg the lOth Regimental headquarters markers used in
the Philippines,and former National Guard formation guidons;
set of chimes made from bell of the old State Capitol and
presented to Hon.John P.Elkin;Spanish cannon to be marke d,
~Brought from Manila,P.I.,by Lt.Col.James E.Barnett,
1899,and presented to the State of Pennsylvania,19 ,in
honor of the lOth Regt.Inf.Pa.Vols.~,water color of
Battle of Caloooan,being copy of original made for Leslie's
Weekly on the spot;chair used by Governor of Guam when con-
fined in Fort San Felipe,Cavite,and by myself when in
connnand of District of Cavite.In case these are not desired
by the state they shall be given also to the Washington County
Historical Society.
ITEM 12.I give and bequeath to T.C.Noble,Esq.,all
of my law books in Pittsburgh office,this including all
books except Encyclopedia Britannica,and all fixtures except
cherry desk and chair,and mahcgany chairs.

ITEM 13.All my residuary estate whether real,personal
or mixed,I give,devise and bequeath to my ~xecutors and
Trustees,hereinafter appointed,in trust for the persons
hereinafter named,who shall have power to sell real estate
without application to Court,the said residuary estate to be
divided in kind,or through proceeds of sale,according to
the discretion of the said Executors and Trustees among the
following persons,their heirs and assigns,share and share
alike:Ella Barnett Finley,M.Olive Barnett,Nancy E.Barnett,
Ralph P.Barnett,1~s.Nettie E.Larimer and Marguerite M.Elder.
ITEM 14.I hereby appoint Charles A.Finley,of Pitts-
burgh,Pa.,and M.Olive Barnett,of Hillside,Pa.,as my
Executors and also as Trustees so far as the same be
necessary in carrying out the provisions of this my last
Will and Te stame nt .In case of the resignat i on or death of
either,the survivor shall have the power to select a Co-
executor or Trustee who shall serve upon confirmation by the
Court.
