I,John F.Chivers,now residing at #268 Linn Avenue in the City of Washington,Washington County,Pennsylvania,being of sound mind and disposing memory,do hereby make and publish this my last Will and Testament,hereby revoking any Wills by me heretofore made. 1.I direct my Executor,hereinafter named,to pay all my just debts,funeral expenses,expense of administering my estate,and all inheritance taxes from the assets of Iny estate. 2.I give and devi se my home,c onsisting of a two story frame dwelling and lots Nos.71 and 72 in Linn's Extension to Washington, e~cept the second floor apartment thereof,to my son David M. Edward Chivers for and during the term of his natural life,pr~vid­ ed however,that if he should marry anyone or have any woman keep- ing'house for him or staying in his part of said house,e~cept a respectable white woman,then his interest in said property shall cease and said real estate shall be sold by my Executor,if and when my Executor shall consider that tbe provision has been violated. 3.All the household goods and furniture that I may have in above mentioned house I give and be~8.th to my son David M.Edward Chiver$ under the same terms and conditions as the real estate above men- tioned,no Bond to be required of said life tenant. 4.I diredt that my Executor shall have charge of and look after renting the second floor of said dwelling,collecting the rentals and making payments therefrom for expenses or commissions for said services,all taxes and insurance premiums and all repairs to said dwelling house,which the Executor shall from time to time deem necessary,and from tim~to time make distribution from the balance to my son David M.Edward Chivers during his life time,unless his interest in said property is terminated by violation of the provis- ion hereinabove set forth. 5.If there is sufficient money left in my estate over and above what is necessary to comply with the provisions of Item No.1 of this Will,I direct my Executor to have repairs made to the house, that in his opinion are necessary and proper,and to make payment for same only after itemized bills for labor and material are uub- mi tted to him. 6.Upon the termination of the above mentioned life estate,either by death or by violation of the said provision,then I direct my Execut§r to sell said real estate and household goods and furniture at either public or private sale,and divide the net proceeds &1ong my grand-children,liVing at my decease,prOViding however,that should any of my grandchildren die at any time prior to distribution, leaving issue,then said issue shall take their parent's share. 7.I give and bequeath ,to my son William Alvin Chivers,one eom- plete set of rig builders 'tools,unle ss I have given them to him since the execution of this Will. 8.I give and devise my interest (being the undivided one half) in lot No.38 in Section M,in the Washington Cemetery,to my sons David M.Edward Chivers and William Alvin Chivers. 9.I give and devise my 1/16 interest in the Peden gas wells to my daughter Freda C.Arthur. 10.I give and devise my interest in the Harts Valley Oil &Gas Co.as wells on the F.W.Crile farm in West Bethlehem Township, to Josephine C.Clark and Freda C.A rthur,my daughters. 11.I give and devise ~interest,including all rentals due there- • from,in the house and lot located at #256 Linn Avenue,Washington, Fa.,which I inherited from my parents,Frederick and Mary Elizabeth Chivers,to my daughters,Josephine C.Clark and Freda C.Arthur. 12.I authorize and empower my Executor to sell at either public or private sale any or all real estate which I may own or have any interest in,at what price and on What terms he shall deem sufficient when and if he shall consider such sale for the best interest of my estate,giving r~said Executor full power to execute and deliv- er a good and sufficient dee.or deeds for same. 13.All the rest,remainder and residue of my estate,I give, devise and bequeath to my children,namely:Glenn R.Chivers,David .L Edward Chivers,William 1#1I##H Alvin Chivers,Elva C.Kent, Josephine C.Clark and Freda C.Arthur,in equal shares. 14.I hereb,y nominate and appoint R.James Knox,Esq.,to be the Executor of this my last Will and Testament,without giving any Bond for the srone. ~~In witness whereof,I have hereunto set my hand and seal this ~day of January,1945. ~~.~(SEAL) Signed,sealed,publi~~ed and declared by the above nroned testator as and for his last Will and Test~lent in the presence of us,who at his request and in his presence and in the presence of each other have hereunto set our names as subscribing witnesses.
