FIRST:I direct the payment of all my just debts and funeral expenses,as soon as conveniently may be,after my decease. SECOND:I give and bequeath all my household goods,jewelry,automobiles and other articles of purely per- sonal use to my wife,PHILOMENA D.COLBERT,or if she has pre- deceased me,then to my son,CHARLES F.COLBERT,Jr.,and my daughter,MILDRED COLBERT MANKER (Mrs.Forrest '¥.Manker),in equal shares,or to the survivor thereof. THIRD:If my said wife,PHILOMENA D.COLBERT,sur- vives me I give,devise and bequeath all the rest,residue and remainder of my estate,of whatsoever kind and wheresoever situate,including any estate over which I may have the power of appointment,to my son,CHARLES F.COLBERT,Jr.,as Trustee,TO HAVE AND TO HOLD the same and the investments into which it may hereafter be converted,and to sell,invest and reinvest the same from time to time,in his discretion,in such stocks,bonds,mortgages and other securities as the Trustee may select,without being limited to those investments designated as legal investments by the laws of the Common- wealth of Pennsylvania now in force or which may hereafter be enacted with respect to trust funds,and the Trustee in his •• discretion may take and retain as investments hereunder so long as he may deem it advisable to do so,without any liabil- ity for loss by depreciation in the value thereof,any of the property which may comprise my estate at the time of my death, IN TRUST,NEVERTHELESS,for the following uses and purposes: (a)The Trustee shall collect,recover and receive the interest,dividends and other income upon the same when due and payable,and,less the expenses incident to the manage- ment of the trust,pay over the entire net income from said trust fund to my wife,PHILOMENA D.COLBERT,in convenient in- stallments,for and during the term of her natural life. (b)Upon the death of my said wife the balance of the principal of this trust fund shall be paid over and dis- tributed to my son,CHARLES F.COLBERT,Jr.,freed and dis- charged of any trust whatever;and if he shall have predeceas- ed her then the balance of the principal remaining in this trust fund shall be paid over and distributed to THE UNION TRUST COMPANY OF PITTSBURGH,Trustee under an Insur- ance Trust Agreement of Charles F.Colbert,Jr.,dated March 16,1932,to be added to the fund held thereunder and held, invested and distributed in accordance with the terms of said agreement and any amendments thereto. (c)In the event of accident,sickness or any other emergency occurring to my said wife,or in the event that the income payable to her from this fund and from other sources is not sufficient to provide for her comfortable maintenance and support,I hereby authorize the Trustee hereunder to pay over and distribute such portion of the principal of this trust fund as he in his unlimited discretion may deem advis- able to provide for her comfort and wellbeing under the circum- --2-- •• stances. •• Cd)In the event that my said son, Charles F.Colbert,Jr.,shall predecease me,or in the event that he survives me and dies prior to the termination of this trust,I hereby nominate,constitute and appoint THE UNION TRUST COMPANY OF PITTSBURGH as the Trustee for the trust herein created,with all the duties,rights,powers and privileges hereunder conferred upon my said son as Trustee. FOURTH:In the event that my wife predeceases me I give,devise and bequeath that portion of my estate which I have inherited from my said wife to my son, CHARLES F.COLBERT,Jr.,and my daughter, MILDRED COLBERT MANKER,in equal shares,the issue of either who may be deceased to take the share to which his or her parent,if living,would have been entitled. FIFTH:In the event that my wife predeceases me I give,devise and bequeath all the rest,residue and remaind- er of my estate,of whatsoever kind and wheresoever situate, to my son,CHARLES F.COLBERT,Jr.;and if he shall have pre- deceased me then I give,devise and bequeath the same to THE UNION TRUST COMPANY OF PITTSBURGH,Trustee under an Insur- ance Trust Agreement dated March 16,1932,to be added to the fund held hereunder and held,invested and distributed in ac- cordance with the terms of said agreement and any amen~~ents thereto. SIXTH:I hereby authorize my Trustee and my Ex- ecutor hereinafter named to sell any real estate of which I may die seized or to which I may be entitled,at either public or private sale,for such price and upon such terms and con- ditions as he shall deem most advaLtageous to my estate,and --3-- •••• to execute,acknowledge and deliver all such deeds,agreements and other instruments in writing necessary or expedient in order to effect such sale,and I'dthout any liability on the part of the purchaser or purchasers thereof to see to the ap- plication of the purchase money. SEVENTH:I hereby direct ~J Executor hereinafter named to pay any and all State and Federal Inheritance and Es- tate taxes assessed against my real estate or any of the legacies or devises herein give~out of the residue of my es- tate so that the said legacies or devises shall be free of tax.
