WILL OF W.E.HERVEY I,W.E.HERVEY,of the Village of West Alexander, County of Washington,State of Pennsylvania,do make,publish and declare this my Last Will and Testament and do hereby revoke and annul any Will or Wills,or Codicils thereto,hereto- fore made by me. ITEM I.I direct that my Executor,hereinafter named,shall pay all of my debts,funeral expenses and the costs of administering my estate,as soon after my death as may be convenient. ITEM II.I bequeath One Dollar ($1.00)to each of my children,Marguerite Hervey Brown and Jane Hervey Kennedy, as they have been amply provided for by me during my lifetime. ITEM III.I devise to my sister,Mary Hervey Black, for life,my two houses and lot situate in West Alexander,Penn- sylvania,on the southerly side of Highland Avenue,which lot is one hundred ten (110)feet wide,extending from Highland Avenue one hundred fifty (150)feet to a field of about three (3) acres and Mrs.Whittem's line;and my house and lot situate in West Alexander,Pennsylvania,on themortberly side of Highland Avenue,which lot is approximately fifty (50)feet wide.During the life of my said sister my Trustee shall pay the taxes -and insurance on said property and such repairs as may be reasonably necessary to keep the property in good condition. ITEM IV.I bequeath to my said sister,Mary Hervey Black,for life,all of the personal property situate in and -1- • upon the aforesaid house and lot except the furniture in my deceased wife's bedroom,consisting of bedstead,dresser,ward- robe,washstand,highboy and marble clock,all of which I bequeath to my only grandchild,Margaret Ann Brown.Except as to the furniture in my deceased wife's bedroom,herein be- queathed to the said Margaret Ann Brown,the decision of my said sister shall be final as to what personal property situate in and upon the aforesaid house and lot is her own,and my sister shall not be required to file bond. ITEM V.All the rest,residue and remainder of my estate~real,personal and mixed,I give,devise and bequeath to Fidelity Trust Company,of Pittsburgh,Pennsylvania,IN TRUST HOVlliVER,and from the net income received to,first - pay the taxes,insurance and repairs upon my property situate in West Alexander,Pennsylvania,and upon my property in Martins Ferry,Ohio,and,second -pay the balance of said net income from my real arid personal estate to the Board of Foreign Missions of the Presbyterian Church in the United States of America. In the event that my Trustee disposes of my property in Martins Ferry during the lifetime of my sister, Mary Hervey Black,the proceeds thereof shall be paid over to the said Board of Foreign Missions of the Presbyterian Church in the United States of America. Upon the death of my sister,Mary Hervey Black,the Trustee shall,within a reasonable time thereafter, however at its sole discretion,dispose of my property in West Alexander,Pennsylvania,and my property in Martins Ferry,Ohio, in the event it has not already been sold~and pay over the -2- I • net proceeds of said properties,together with all my personal property then remaining in its hands,to the Board of Foreign Missions of the Presbyterian Church in the United States of America. This gift to the Board of Foreign Missions of the Presbyterian Church in the United States of America is made in honor of my daughters,Marguerite Hervey Brown and Jane Hervey Kennedy,to be applied by said Board exclusively for active missionary work in India and in China,and not for re- tired or disabled ministers. ITEM VI.I authorize my Trustee to accept and to retain at its discretion any and all investments and securities of which I die possessed and it shall not be liable for deprecia- tion in the value of any such securities. ITEM VII.I authorize my Executor and Trustee to sell at its discretion,at either public or private sale,any and all real estate of which I die seized,with power to make,execute and deliver the necessary deed or deeds therefor. ITEM VIII.I own a lot on Neville's Island,Pennsyl- vania,which I regard as worthless.I suggest,therefore,that my Executor abandon said lot and pay no taxes thereon. ITEM IX.I direct my Executor to pay all transfer and inheritance taxes,whether State or Federal,from the corpus of my residuary estate.
