ARTICLE I:I direct all my debts and funeral expenses be paid from my estate as soon as practicable after my death. ARTICLE II:I give and devise to my daughter, AGNES MARIE LESNIAKOWSKI,if she survives me,the following described parcels of ground,provided that I still own the said real estate at the time of my death: (a)ALL that certain tract of ground situate in North Strabane Township,Washington County,pennsylvania containing 17.5070 acre and being more fully described in Deed of Jesse M.King,unmarried to steve Gubasko, et ux.,of record in the Office of the Recorder of Deeds of Washington County,pennsylvania in Deed Book 1762,page 259; (b)My house and the lots of ground upon which it is situated,being known as 201 Crawford Street,Canonsbur , Washington County,pennsylvania,together with all household furniture,goods,fixtures and all such personal property located therein; (c)That certain cemetery lot registered in my name with st.patrick's Roman Catholic Church of Canonsburg, Washington county,pennsylvania,situate in st. patrick's Cemetery (Old Section)in Canonsburg, Washington County,pennsylvania. ARTICLE III:I give,devise and bequeath all the rest,residue and remainder of my Estate,real and personal to my daughter,AGNES MARIE LESNIAKOWSKI,in trust,nevertheless, under the following terms and conditions: (a)The trustee shall hold the principal of the trust as one fund and shall expend such amounts of net income of the trust and if the net income is insufficient,such amounts of principal therefrom as the trustee,in its sole discretion,deems -- advisable for the health,maintenance,support and complete education of my grandson,ROBERT STEVEN LESNIAKOWSKI,such educa- tion to include preparatory,college and post graduate or pro- fessional training.In the event the trustee does not expend all the net income during a given year,the trustee shall add said unexpended income to principal and invest it as such.Such distributions of net income and principal may be applied directly, or if such beneficiary is a minor,may be made to the Guardian or other legal representative of such minor or to the person with whom he or she resides,without liability on the part of the trustee to see to the application thereof. (b)At such time as my grandson,ROBERT STEVEN LESNIAKOWSKI,shall have attained the age of twenty-five (25)yea s, the principal of the trust estate as then constituted shall be distributed,free of trust,to my grandson,ROBERT STEVEN LESNIAKOWSKI .~ (c)All share of principal and income shall,until actual distribution to the respective beneficiary,be free from the debts,contracts,alienations and anticipations of any bene- ficiary and the same shall not be liable to any levy,attachment, execution or sequestration. (d)All dividends on shares of a corporation,farming a part of the principal,which are payable in the shares of the corporation itself of the same kind and rank as the shares on whic such dividend is paid shall be deemed principal. (e)The trustee shall receive compensation on the gross income of the trust,and in addition thereto,a reasonable fee based on the market value of the principal of the trust estate, which fee shall be in accordance with the then prevailing rate of compensation not to exceed that which would be allowed by a court having jurisdiction over a similar trust. ARTICLE IV:In the event either of my said beneficiaries Shall have predeceased me,then and in that event, the deceased beneficiary's share shall be distributed to the survivor of the said beneficiary. ARTICLE V:All estate taxes,inheritance taxes, transfer taxes and other taxes of a similar nature payable by reason of my death to any government or subdivision thereof upon or with respect to any property sUbject to any such tax shall be paid by my executrix or executor out of the principal of that portion of my estate hereinbefore disposed of by Article III, including the taxes on both life estates and remainders created under this will or by trust,and all interest with respect to any such taxes shall be paid by my executrix or executor out of the income or principal or partly out of the income and partly out of the principal of such portion of my estate,in the absolute discretion of my executrix or executor,without reimbursement froIT or apportionment among the beneficiaries,recipients,or owners' of such property for any such taxes or interest.Notwithstanding the foregoing directions,my executrix or executor may decline to pay all or any part of the inheritance taxes with respect to any remainder interest if in his or her discretion,he or she deter- mines such action to be for the best interests of my estate; provided that any postponed taxes on remainder interests shall be charged against the principal of the particular share with respect to which the taxes are imposed. ARTICLE VI:I appoint my daughter,AGNES MARIE LESNIAKOWSKI,Executrix under this Will.No fiduciary under this Will shall be required to give bond or other security for the faithful performance of their duties.
