PC·4 THE STATE OF OHIO, MAHONING COUNTY,SS: No.26004 BE IT REMEMBERED,That heretofore,to-wit: On the 25th day of February,in the year of our Lord, One Thousand Nine Hundred and Thirty-seven,in the Probate Court,within and for the County of Mahoning and State of Ohio,an instrument in vvriting purporting to be the last Veill and Testament of Thomas B.Harris, Sr.,late of Youngstown,this County,deceased,was produced in open Court for probate;it is now ordered that the said will he filed in this Court and it appear ing to the Court that the next of kin of the test~tor, resident of the State of Ohio,have waived the issuing and service of notice and consent to the probate of said will;notice is dispensed with and said applicatio will be for hearing before this Court on the 1st day of March,A.D.1937,at 10 o'clock,A.M. THEREUPON on the 25th day of February,A.D. 1937,at 10 o'clock,A.M.,John B.Morgan appeared in open Court and made application for a Commission to issue to some suitable person to take the deposition of Dorothy Morgan Butler,witness to the ~ill of said Thomas B.Harris,Sr.deceased.And it appearing to the Court that said witness resides out of the jurisdic tion of this Court,to-wit:at Oberlin,Lorain County, Ohio. It is therefore ordered that such Commission, with said will annexed,issue to Otis C.McKee,Oberlin Savings Bank,Oberlin,Ohio,a suitable person,to be duly executed,and together with the deposition of said MAHONING COUNTY PROBATE COURT Clifford M.Woodside JUDGE PC·" witness so taken,signed,certified and sealed,be re- turned to this Court with all convenient speed,and this cause is continued. THEREUPON on the 1st day of March,A.D.1937, at 10 o'clock,A.M.,this cause came on to be heard and it appearing to the Court that the next of Kin of the testator,resident of the state of Ohio,have waived the issuing and service of notice and consent to the probate of said ~ill;thereupon this day came John B. Morgan,one of the subscribing ~itnesses to said VQll, who being dUly sworn,testified to the due execution and attestation of said Will;v~hich testimony was reduce to writing by said witness subscribed and filed with said will. Also this day tne commission heretofore issued herein to Otis C.Mc~ee,commanding him to take the deposition of Dorothy Morgan Butler,the other subscrib-' ing witness to said will ~as returned to this Court,dul executed and was filed herein. ~HEREUPON the Court finds from the testimony and deposition taken that said instrument of ~Titing is the last will and testament of said Thomas B.Harris,Sr deceased,that the same was duly executed and attested and that the said testator at the time of making,signin and sealing the same was of full age and of sound mind and memory,and not under any restraint. ITEM 2.I direct that my Executor,herein- after named,cause a suitable marker to be placed at the grave of my Wife;also at the ~rave of myself; and that a suitable monument be erected on our family lot in Belmont Cemetery,Youngstown,Ohio,I hereby set apart out of my estate the sum of Five Hundred Dollars ($500.00)which I direct shall be used by my Executor for the purchase and placing of said markers and monument.
