FIRST.I appoint Ellery A.Gardner,Jr.,my beloved son,as Executor of this,my Last Will and Testament.I direct that no bond shall be required of my said Executor.My said executor,in addition to the powers conferred by law,shall have the power to sell at public or private sale,to exchange or to lease,for any period of time,any real or personal property,and to give options for sales,exchanges or leases for such prices and upon such terms or conditions as he shall deem proper. SECOND.I direct that all my just debts and funeral expenses be fully paid and satisfied as soon as conveniently may be after my death. THIRD.I give,devise and bequeath all of my household furnishings and personal effects to Ellery A.Gardner,Jr.,my beloved son,if he shall survive me. FOURTH.All the rest,residue and remainder of my estate I give,devise and bequeath to Ellery A.Gardner,III,my beloved grandson. In the event the said Ellery A.Gardner,III,shall predecease me I direct that the rest,residue and remainder of my estate shall be distributed to Ellery A.Gardner,Jr.,my son. FIFTH.I make no provision for my other son,Robert L. Gardner,his whereabouts being unknown to me. SIXTH.I appoint my son,Ellery A.Gardner,Jr.,as guardian of any estate that my grands~n,Ellery A.Gardner,III,might be -1- entitled to as a result of my death,giving to my said appointee the following powers:To retain in kind any such property,real or personal, received by it from any source;to sell any such property upon such terms and conditions as it believes advisable,giving good title to any real estate thus sold;to invest and reinvest in such stocks,bonds and other investments as it deems advisable,without being limited to those investments in which guardians are by law required to invest a minor's funds;and to disburse to or for the benefit of such minor so much of the income from and the principal of the minor's said property as it deems advisable for the minor's comfort,welfare,maintenance,support and complete education,including preparatory,college and post-graduate or professional training. SEVENTH.I direct that all taxes that may be assessed in consequence of my death,of whatever nature and by whatever jurisdiction imposed,shall be paid from my residuary estate as a part of the expense of the administration of my estate. EIGHTH.In construing the provisions of this,my Last Will and Testament,use of the masculine,feminine and neuter genders shall include the others;the singular shall include the plural and the plural shall include the singular;and words used in the past tense or present tense shall include the future tense.
