TO THE HONORABLE JUDGE OF SAID COURT:
The petition of EDITH MAE WELCO BARD,respectfully represents:
1.Decedent,Lulu Lucretia Foflygen also known as Lulu L.
Foflygen,died June 22,1982,a resident of the City of Washington,
Washington County,Pennsylvania,having first made her Last will and
Testament dated June 9,1970,which was probated by the Register of
Wills for this County on July 6,1982,and Letters Testamentary issued
thereunder to Margery Bainbridge,a copy of said will being hereto
annexed as Exhibit A.
2.Since the probate of said Will,another writing has been found
by your Petitioner,undated,same being annexed hereto and marked
Exhibit B.
3.The parties in interest under the probated will are as follows:
(1)Edith Mae Welco Bard
(2)Thomas Welco
(3)Mary Baker
(4)Rebecca Ellen Welco,a minor
all of said parties in interest are living except Mary Baker who
predeceased Decedent and all are sui juris except Rebecca Ellen
Welco who is a minor,age 13,and residing with her cousin,Agnes
Lee,at Oak Harbor,Ohio 43449.
4.In order to secure the probate of said undated writing,
this appeal is filed with Your Honorable Court from the decision
of the Register OT Wills in the above captioned estate to the
probate of said will dated June 9,1970,with the request that the
record of the entire proceedings be duly certified to Your
Honorable Court.
5.That more than three months have passed since the probate
of the original Will.
WHEREFORE,your Petitioner prays that a Citation be issued
directed to Edith Mae Welco Bard,Thomas Welco and Rebecca Ellen
Welco to show cause why said appeal should not be sustained and
decree be entered authorizing and directing the Register of wills
of Washington County to open the Decree of July 6,1982,probating
the will of said Decedent,to admit the probate of said undated
writing as the Last Will and Testa f Decedent.

I,LULU L.FOFLYGEN,of Washington,Washington County,
Pennsylvania,being of sound and disposing mind and memory do
hereby make,publish and declare this to be my Last Will and
Testament hereby revoking any and all Wills heretofore made by me.
FIRST:I direct that my executor pay all of my just
debts and funeral expenses as soon as may be convenient after my
decease.
SECOND:All the rest,residue and remainder of my
estate,real,personal and mixed of whatsoever kind and wheresoever
the same may be situate I give,devise,and bequeath to Marsery
Bainbridge,presently of 104 Charles Street,Washington,Washington
County,Pennsylvania in trust for Edith Mae Welco,Thomas Welco,
Mary Baker and Rebecca Ellen Welco,and direct that the money held
by the said trustee shall be used for the care,maintenance and
comfort of those named at the sole discretion of the trustee.
THIRD:The trust shall continue for the benefit of
the survivors in the event of the death of any of the beneficiaries
thereof and the trustee shall not be required to post bond or be
responsible to account to any court for distribution thereunder.
FOURTH:Upon the death of the trustee,Margery
Bainbridge,or upon Rebecca Ellen Welco becoming 21 years of age,
or whichever event occurs first,the trust shall terminate and any
balance remaining therein shall be distributed to Rebecca Ellen
Welco.
FIFTH:It is my desire,however,that Rebecca Ellen
