I,James B.Chambers,of the Borough of West Alexander,Washington County,Pennsylvania,do make and declare this to be my last Will and Testament,hereby revoking any and all former wills by me heretofore made. First;I direct that all my just debts and funeral expenses be paid out of my estate,as soon atter my decease as the same may be done, consistent with the proper and legal management of my estate. Second;I give,devise and bequeath to The James B.Chambers Memorial Association of Ohio County,West Virginia,the sum of Fitty Thousand ($50,000.00)Dollars to be kept and held by them in trust however, for the following uses and purposes; a.To invest and reinvest the same in any securities that they may deem proper,giving preference,if deemed advisable by said Trustee, to United States,state and Municipal securities,and likewise to take and hoI first mortgages on real estate in Ohio County,West Virginia,or on real estate in Washington County,Pennsylvania,or to invest in such other securi- ties as in the jUdgment of said Trustee are believed by it to be conservative and well secured,and in its discretion to investigate,from time to time, securities and investments taken over or held by it,and if deemed advisable to change the same into other securities or investments as said Trustee shall see fit,keeping in mind,however,at all times,the safety of the corpus of the trust fund rather than the amount of income to be derived therefrom;and to collect and pay over the income which shall be derived therefrom,semi- annually,to my wife,Maude A.Chambers,during her life,if she shall so long continue my Widow,the same to be paid to her personally and not to be inticipated or subject to attachment or assignment.Upon the death of my said wife,or her remarriage,my said Trustee shall turn over and deliver the corpus of the said trust fUnd of 50,000.00 to the James B.Chambers Memorial Association,or its authorized agents,a corporation of the state of West Virginia,to be its property and possession absolutely. Third;It is also my Will that my said wife shall have the use of my dwelling house with the lands,tenements and appurtenances belongirig thereto or connected therewith,situated in the Borough of West Alexander, Pennsylvania,and now ccupied by me,as a place of residence during her said 1-- ..J,•• widowhood,and shall also have,during her said widowhood,the use of all household goods,furniture,linens,silverware,ohina,etc.,looated in said house and all other movable artioles and effects for domestic or household use or ornament now in,or which shall be in,about or belonging to my said home,PROVIDED HOWEVER,that she shall devote a portion of her time to the ~ames B.Chambers Memorial Association.Upon the death or remarriage of my said wife,the said dwelling house,together with the lands,tenements and appurtenanoes thereto,and the said household goods,furniture,etc.,herein- above referred to,shall go to and be the property and possession absolutely of the James B.Chambers Memorial Assooiation. Chambers Memorial Association o~Ohio County,West Virginia,a sum not to exceed TWenty-~ive Thousand (25,000.00)Dollars to held in trust by them however,for the tollowing uses and purposes; a.~o take said sum of money,or so much thereo~after investiga- tion as may be determined to be proper and necessary,to purchase therewith a home for my said daughter,Hazel G.McGill,providing the said location and price meets with the approval of my said Daughter,due regard being had to the actual valutation and marketability of the home purchased and the satety ot the investment.My said daughter,Hazel G.McGill,is to have and enjoy the use and occupation of the said home ~or and during her life without authority,however,to encumber or alienate the same,and upon her death the said home is to go and belong to the James B.Chambers Memorial Association absolutely. Sixth;I do further give,devis and bequeath to The James B. Chambers Memorial Association of Ohio County,West Virginia,the sum of Twenty Thousand ($20,000.00)Dollars,to be kept and held by them in trust, however,for the following uses and purposes; a.~o invest and reinvest the same in any securities that they may deem proper,giving preterence,if deemed advisable by said Trustee,to United states,state and Munioipal securities,and likewise to take and hold ~irst mortgages on real estate in Ohio County,West Virginia,or on real estate in Washington County,Pennsylvania,or to invest in such other securities as 1n the judgment of said Trustee are believed by it to be con- servative and well secured,and in its discretion to investigate,from time to time,seourities and investments taken over or held by it,and it deemed advisable to chang the same 1nto other securities or investments as said Trustee shall see tit,keeping <in mind,however,at all times,the safety ot the corpus of the trust tund rather than the amount of inoome to be derivea therefrom;and-to use the income from this trust fund as follows; b.To pay for the maintenanoe and operation of the homes herein- above reterred to,that 1s,the homes of my said wife and said daughter. Said maintenance to oonsist of taxes,insuranoe charges and all repairs and improvements necessary to keep the said homes in good and habitable condition. -3- • .-.-. It there is any amount lett over atter the payment of the cost of mainte- nance of said homes,then the said amount of income so lett over shall be paid over to the James B.Chambers Memorial Association.These payments or adjustments shall be made annually,or so often as conditions will permit. Upon the death of my said wife and daughter,the corpus of this trust fund shall go and beoome the property and possession absolutely of the ~ames B. Chambers Memorial Assooiation. Seventh;I give,devise and bequeath to the James B.Chambers Memorial Association of Ohio County,West Virginia,the sum of Five Thousand {$5,OOO.OO}Dollars,to be kept and held by them in trust however,for the following uses and purposes; a.To invest and reinvest the same in any securities that they may deem proper,giving preference,if deemed advisable by said trustee, to United stetes,State and Municipal seourities,and likewise to take and hold first mortgages on real estate in Ohio County,West Virginia,or on real estate in Washington County,Pennsylvania,or to invest in suoh other seourities as in the judgment of said Trustee are believed by it to be oonservative and well seoured,and in its discretion to investigate,from time to time,securities and investments taken over or held by it,and if deemed advisable to ohange the same into other seourities or investments as said Trustee shall see fit,keeping in mind,however,at all times,the safety of the oorpus of the trust tund rather than the amount of inoome to be derived therefrom;and to oolleot and pay over the inoome which shall be derived there from,semi-annually,to my house-keeper,Hattie Brook,during her life,the same to be paid to her personally and not to be antioipated or sUbjeot to attachment or assignment.Upon the death of my said house-keeper,Hattie Brock,my said Trustee shall turn over and deliver the corpus of the said trust fund of $5,000.00 to the James B.Chambers Memorial Assooiation,or its authorized agents,4 oorporation of the state of West Virginia,to be its (,property and possession absolutely. Eighth;I hereby authorize and empower and direct my Executor here- ina~ter named to sell at publio or private sale,all the real estate or any interest therein of which I shall die seized or possessed,wherever the same may be situated,on such terms and in such amounts as may be regarded safe and advisable and for the best interests of my estate,and the proceeds of such ..:4 •'........""- ,.. ..~.,.~ •,.4fsale ~or sales,less the oosts and necessary expenses to be applied first, if necessary,to establish and complete the trust funds hereinabove set forth,and the balance to be paid to and belong to the said James B. Chambers Memorial Association,a corporation as aforesaid,of the County of Ohio and state of West Virginia,and the purohaser or purchasers are in no event to be held liable for the application of the purchase money. Said Executor is hereby authorized,empowered and directed to execute and deliver to the purchaser or purchasers,such deed or deeds or assurance of title as may be necessary to effectuate and complete said sales,with- out procuring from any Court,authority or order to make said conveyance or conveyances final and conclusive,and without the necessity of making application to any Court for the purpose of ratifying or confirming said sale or sales.• Ninth;It is further my Will,and I do hereby direct that all inheritance taxes,both state and Federal,shall be paid out of the residue of my estate,and the income hereinabove referred to,to be paid to my wife and daughter,or her children,and my said housekeeper,Hattie Brock, shall be net inoome,exclusive of any charge for inheritance tax. Tenth;I give,devise and bequeath all the rest,residue and remainder of my property,real,personal and mixed,of whatsoever kind and desoription the same may be,and wheresoever situate,unto the James B. Chambers Memorial Association,a corporation of the State of West Virginia. Eleventh;I do hereby nominate and appoint the James B.Chambers Memorial Association of Ohio County,West Virginia,to be the executor of this my Last Will and Testament.
