last Will and testament
Item rdirect my body after my decease to be decently intered in
my lot in the Cemetery near Waynesburg and further direst my Executors to erect
at my grave a ~ooa Substantial plain Marble head &foot stone.
Secondly,rdirect that all my Just debts "hall be p~id
Thirdly I will devise and beaueath to my four Sons and to their
heirs Viz.James Ely,George Ely,Jonas Ely and Caleb Ely all the real estate
of which I may die possessed bein~a farm in Franklin Township Washin~ton COUD-
ty on which my Son James now resldes and my farm in Franklin Township Greene
County upon fhich I nov reSl0e to be equally divided among them and it is my
earnest Wish and desire that my Said Sons Shall divide Said lands amicably.
And I further direct that as my youngest Son Caleb Ely is no f in the army of
the United States fighting [or our riehts and the liberties of Our Country
if he Should loose his life and never return,I direct that then my land before

granting Letters of Administration in and for Said County Personally appeared
John C.Flenniken one of the Subscribing fibnesses to the foregoing instrument
of ~ritin9 and being duly qualified according to law did deDose and Say that
he was present Saw and heard the Testator Jonas Ely,Sign,Seal,publish pro-
nounce and declare the fore~oin~instrument of writing as and fa his last ~ill
testa~ent,and that at the time of his so doing he was of Sound disposing
mj.nd memory and understendj.n~to the best of his knowledge observ~tion and be-
lief end that he siQned the same as a Subscribin~Witness at his nequest,and
